I have been going to school for nursing since 2002, obtained my LPN and now just passed my NCLEX-RN. Just wondering if there are hopsitals who hire ADN-RN who are not Americans.:

The issue you have is retrogression and currently not able to AOS. This means unless you stay as a student there is no way at the moment to stay legally in the US and work. Retrogression has been ongoing since Oct 2006 with many many nurses affected including international students

A hospital can hire you, but you cannot work without a visa that will permit you to work and those are not available now due to the retrogression. The only way for you to remain in the US is to continue on with your studies and remain under your student status.
A hospital can petition you, but they do not issue the green card. That is done only by the US federal government.
Congratulations on passing the NCLEX exam. If you do not have the OPT from this RN program, there is no way that you will be able to work now.

Oh, the hospitals will hire you alright, IF you're authorized by DHS to work. if you have an EAD that shouldn't be a problem. Did you get OPT? I've been so busy running between 2 states i don't hear much but last time i checked last week, USCIS is soo backed up it's not even funny. I know lots of people rushed to send their forms in last year before the fees went up and they were still functioning OK. This year, they're taking about 3x longer to process the same stuff. i know some students will have to have their start date moved back cuz they haven't gotten their OPT card yet.
If you do get the OPT, it allows you to work for a year, if you haven't used some of your months for pre-completion OPT.
If they just wrote the NCLEX exam, and no mention of having the OPT; doubt if they ever applied for one.
And if they wrote the exam, it means that they have graduated, so too late to apply for it.

Thankyou very much for your quick response. Just one more question. I used my OPT after getting my LPN, when do I qualify for another OPT. Can I apply for one, graduation was April 25th. I am currently regestered for Fall RN-BSN, also, when can I use CPT? I have read about Precompletion and post-completion OPT. How does that work, and is it for 29 months after graduation. I am confused. when can I start the process of visa screen?
You would have been able to get the OPT for the RN, but the major requirement is that it must be applied for before you actually complete your program. Shame on your international advisor for not telling you this beforehand.
OPT for nursing is only valid for one year, it is not for the extra time that you are seeing for some fields.
You will have to be in your program again for usually one year to be able to get the CPT, it will depend on the program that you are attending and if they offer it. Not all programs do.
You can go ahead with the Visa Screen Certificate at any time, but you still need to be aware that other than the OPT, there are no visas that are available and we do not expect the AOS to open up for quite some time, perhaps five years from now as they accepted 800,000 petitions last summer and there are only `140,000 green cards issued per year and that 800,000 does not include those that are waiting for a visa out of the US.
Sorry that you are going thru this and that no one told you about the OPT with the ADN before you finished.
You coulda gotten the OPT before after your ASN but you can't get it after you graduate. You'll have to apply before you graduate (they do have deadlines corresponding to the graduation date so your advisor shoulda told you about the deadline). If you missed it this year, you can get the OPT next year when you gruduate with your BSN.
The 29month OPT doesn't apply to nursing. it only applies to specific majors and even with that, there are certain requirements. You can apply for pre-completion OPT but based on what i know, i'd strongly suggest you apply for CPT if you're still in school.
Pre-completion OPT allows you to work while still in school. 20hrs/week and f/t when school is not in session. The catch is that every month of pre-completion OPT = 1/2 month of post completion OPT which means that if you take 10months pre-completion OPT, 5months will be deducted from your OPT time so when you apply for post-completion OPT you can only apply for 7months.
In my personal opinion, if a person is in school, it's better to get the CPT because you make a lot less than an extern than as an RN and so wasting 5months of OPT time doing CNA work doesn't quite cut it.
CPT has it's own requirements but at least that's issued by the Int'l students office after they've seen proof of employment and other stuff stating what exactly you'll be doing, blah.blah...blah.
Talk to your advisor, the good ones i've met do know a lot.
Thankyou very much. Actually my DSO refused me to apply for OPT stating that I had already used my OPT for my LPN. N-way, I am currently using CPT as an RN before I start School in Fall, and I will start the VISA sceen application. Does it matter if I am still in school to apply for the Visa screen, and if I am qualified, can I continue with school or can I stop. It may sound stupid but I just dont want to keep going to school for so long if I have an option. Lastly, Which parts of the process do I fill since am except from Toefl requirements?

If you have passed NCLEX and meet other requirements then it is OK to get VSC. To legally stay in the US at the moment is to stay as a student so continue with school.

You are unable to stop going to school if you wish to remain in the US, you must remain as a full-time student to be able to keep your visa current.
Sorry that your school gave you wrong advice, you normally can use the OPT when you complete the ADN program.
All of the requirements will need to be completed by you, the only thing waived is the English requirement.
Not sure how you are using the CPT if you are going to be going to a new school, am I correct on this? Anything from your old program would no longer be valid and the requirements for the new program are not in place yet.
