hi suzy13! may i know what is your visa when you get there in the us? thanks. you can pm me your response.
and is currently not accepted. It basically is illegal to use this route of using tourist visa with intention of changing status and with the clampdown of illegal immigrants and retrogression expect huge problems and tourist visas hard to apply forjust in case anyone reading this is thinking on trying this route
Please be not quick on passing judgment. Some "Tourist Visa" holders had no intention to immigrate when they came. However, due to insistence of relatives, they change their minds and stayed for good. IT IS LEGAL TO CHANGE YOUR INTENTION. If it is not, then there must not be a route from B2 to Greencard, but there is.
If somebody came on a tourist visa with an intention to immigrate, then that is illegal. The port of entry official must have not allowed him/her to enter.

but even then it is not possible unless marrying a US citizen to expect to change your status and stay and even then no guarentee that you can stay. For a relative to change their status you are looking at years. Same if a GC and you get married you are looking atleast 2 years before your spouse can change status and get a GC and be able to stay. Have seen this happen a lot on another immigration support website I go on, also if you look on the visa bulletin at family based you can see the processing times and it is not immediate. They will generally not get EAD unless their PD is being processed. This is how I read things have to be done and my interpretation
Yes it is legal if you change your intent like you describe but have seen it many times on here where the tourist holder admits to wanting to try this route which is not fair on all the people from all the countries wanting to do it the proper way and many lie to the immigration officer and give false information then the officer will not know of intent to AOS
and also after thinking about this, the fact they, the person, are making enquires on how to do this route is showing intent and therefore not fair on the people doing it proper and make it harder for the ones who go the route you mention re change their mind afterwards and fit the criteria to AOS
On some perspective, 'intent' is a big word. People inquiring about this route is not necessarily having the 'intent' to do it. They maybe are looking at the roadmap and trying the figure out the best way to their destination. What if those who are inquiring were already in the US for the purpose of just visiting friends? Now, after inquiring, they realized that there is a LEGAL way to adjust status from B2 to Greencard. I repeat, it is LEGAL.
The only illegal action is if they lied at the port of entry, which is ground for denial of the AOS.
