Senator HUTCHISON submitted an amendment(SA 364) to S.4 which recaptures the Unused Employment-Based Immigrant Visas and allocates to Schedule A workers...

SA 364:

Recapture of Unused Employment-Based Immigrant Visas.--Section 106(d) of the American Competitiveness in the Twenty-first Century Act of 2000 (Public Law 106-313; 8 U.S.C. 1153 note) is amended--

(1) in paragraph (1)--

(A) by inserting ``1996, 1997,'' after ``available in fiscal year''; and

(B) by inserting ``group I,'' after ``schedule A,'';

(2) in paragraph (2)(A), by inserting ``1996, 1997, and'' after ``available in fiscal years''; and

(3) by adding at the end the following:

``(4) PETITIONS.--The Secretary of Homeland Security shall provide a process for reviewing and acting upon petitions with respect to immigrants described in schedule A not later than 30 days after the date on which a completed petition has been filed.''.

I hope they would just recapture the unused greencard visas...If they will approve this non-immigrant temporary working visa, I think non-immigrant visas will all be used up very quickly...and as Suzzane mentioned, if you have a working visa rather than greencard status, there's a big tendency that your employer would exploit you and you wont get the same salary and same benefits like the US citizen nurses and alien greencard holders..Well the waiting period for my petition really tortures me, but I would rather wait than go to US very quickly and be a non-immigrant worker--get lower pay than the usual and not treated as equal with your immigrant co-workers, in other words-"being exploited and abused"....but I hope the waiting wont last for years, I am crossing my fingers and pray hard that this retrogression would end this summer..

According to http://hammondlawgroup.blogspot.com/, Sen. Hutchison has formally introduced a provision to recapture about 90,000 visas for Schedule A nurse and PTs.

Now, How long we may have to wait to know this bill is passed? What is the next process? If everything went well, How long will it take to retrogression over?

Bills must be approved by both the House of Representatives, as well as the Senate. Nothing gets thru instantaneously. There will be multiple changes made, and multiple meetings as well before anything gets thru.

At the very earliest, there will not be anything opening up until July or later, if you add on how long that it takes for the existing visas to be moved over, etc. Remember that the Schedule A has already been removed from the Visa Bulletin. It would not have been removed if they expected things to open up in a month or so.

And still do not think that there will be a total lift of the retrogression immediately. Just to the number that are waiting for visas. And remember that 90,000 sunds like alot, but more than likely that will still include family members/dependents of the nurse.

With the 50,000 that were last made available, only about 1/3 or less went to nurses. Physical therapists are also included under Schedule A, and then the dependents of both. There are many more that that waiting for a green card right now from all over the world.

Thanks for your reply. Now, my case is like this. My case is in NVC and I got a case number.Last month I got a letter from them saying since visa numbers are not available, they cannot process further (ie. DS230, choice of agent etc.). That case, as soon as retro lifted my file will be processed or will there be any other waiting time?

Pls advice.

It will not be processed immediately when the retrogression is lifted. There is still processing going on right now, so I am thinking that this has more to do with the employer in many cases. I have seen petitions go thru and continue to go thru.

When things do open up, they are going to clear up those that have been waiting longer than you. When was your case actually filed and approved? That means more to me than just that it is at the NVC.

*Also note that Pres. Bush has just gone through Latin America and still is currently in Mexico and the theme there is Immigration Reform. He will be back in the US by wed., the same week where the Kennedy-McCain Bill will be re-introduced. Least to say, this will be an interesting week or so. We will have a better picture of things to come or not to come in this week and the next.

October 2006 for the PD. Looks like you have just started the process, you have some time to wait. Even if there were no retrogression. This is only the beginning. Do you actually have approval on the I-140 and the payment made, and then there is the DS-230.

And the bills being discussed today about immigration reform also are including illegal drug in the US. Not a good combination.

The Kennedy bill is the same bill that proposed to remove any cap on nurses and PTs. This is good news indeed.
