H1b Visa for nurses under FY 2010

I have applied for a work visa for the position as a dialysis nurse. I was filed last april 1 2009 and was wondering when will i get to have a visa? Anyone with a similar status of mine???:specs:

I agree with what others have said. The whole situation sounds very suspicious. Remember that there are a number of unscrupulous recruiters out there, who will take advantage of people if they can. It's a good thing you are asking for advice. It would be a shame if you got your hopes up, spent some money, and ended up being disappointed because it was indeed "too good to be true."

Hi! i'm just a new member here,i'm not that familiar on how this works.since i can't find where to put my inquiry,i will just do it here.I am on a tourist visa right now,I am here at Washington.I already passed california nclex exam,english exam as well as i have already a visa screen.before i left phil.,i met an agency here in washington,she's the one helping me right now to find an employer but the catch is i have to pay 6k for my visa then 5k each for my family member.She said that i'm not qualified to have H1B since i only have a 3yr.experience in med-surgical ward,so she's gonna apply a green card for me.I already saw the facility,its a rehab.do you think,i'm doing the right thing?i know that immigrant visa is close right now so how can i have that visa?but she said that they will give me a temp.work permit.

my family is still in the Phil.and i want them to be included,do you think i have to let them be here before i will apply since they already have a tourist visa.Please guide me this matter,i'm really confused.Thank you

But it says on Page 2 that the employer can meet regulatory requirements by showing that a bachelor's or higher degree (or its equivalent) is normally the minimum requirement for entry into the position, etc.

This is the "catch" for generalist staff nurses -- it doesn't matter what degree you have, it matters what the requirement for the position is. Since the US prepares and licenses RNs via diploma schools and ADN programs in addition to BSN programs, there are virtually no basic staff nurse positions in the US that normally require a BSN.

Retrogression is enforce, you need to return home and file the paper work. There is a high unemployment rate in the US and even if this agency found a sponsor you would still have to wait for retrogression. Sorry there are no short cuts. If you over stay your tourist visa you may effect your chances for later on. Agencies and employers do not give visas only the US government does.

They are not telling you the truth. Retrogression is affecting you and there is no such thing as a temp visa whilst you wait for GC. I would also say that the money they are requesting sounds like a lot. You really need to consider returning back to the Philippines whilst you wait for a visa because you do not want to overstay your tourist visa. I would make sure you know what sort of 'temp visa' they are talking about. If anything goes wrong they are at fault but you are at bigger fault as you are supposed to know the ins and outs of the process

1. the location is in Cape may court house NJ.. eastern shore nursing and rehab.. do you know how much is the usual salary?? i think if the place is expensive to live in the salary i think will also be high?

2. does anyone here paid all their fees here??

3. to tell you honestly i didnt know all about this visas, all the consequences etc,, when i was told and found out that i will be given h1b, i was so surprised and happy coz i really wanna go abroad, now im ony 22, and who doesnt want to be in US right??.. now,, i only found out,, JUST NOW!! that this h1b visa is only for those speciaists.. My employer KNEW that i still dont have hospital experience and i was about to start hospital experience this August 2009. She told me BEFORE that i will be given Immigrant visa,, and just last month the lawyer emailed me that i have to stick with the H1b, maybe because that is the available for now and its already on process.. Also my employer told me that i just need ATLEAST 1 year hospital experience, she says its ok for my transition.. And as for me i trust her that what ever she is telling me is going to be ok as long as there will be no problem,, ofcourse she is my employer,, i really THOUGHT that im qualified with that visa.. I NEVER NEVER NEVER wont do any lies,, i dont like lying coz im afraid of any risk i may get if i lie,, i just wanted everythings gonna be ok,, i want it to be all legal,, fortunately i asked you guys here and i really just know it all now.. :( ... what do you think?? should i stay away from them?? or is there any other option for me to be qualified to have that H1b...

Beware dodgy agencies and attorneys.

My husband worked with someone from Korea recently.

He was in the US on H1B, and was changing employers so needed to change his H1B over.But you are allowed to start work with your new employee, as long as criteria is app for H1B,while they are processing change over.

When the immigration lawyers at my husbands place of work looked at his H1B petition (that had already been approved for his last job) they said everything wasn't correct and told him to go back to Korea until they could try and sort it.

Apparently he was only working contract hours in his last job ie as and when required and this doesn't qualify for H1B.

I believe he has since married his US fiancee.

I have received my H1b visa approval today..Thanks Lord!!I hope this will inspire those who are waiting in line especially those fellow nurses..I am task to have my embassy interview be scheduled next week..Hopefully praying things will work out fine ..:)

Unless you are an advanced practice nurse or are getting an upper management position you are at risk. The rules are clear and you know in you heart if you pass the criteria. You are risking any chance of permanent immigration if you do not meet the criteria.

Typical US nurse only need ADN, therefore read the memo to see who qualifies.
