A word of caution: AGENCIES

the time to check out an agency is before you sign the contract, not after. they are legally binding contracts and are not easily cancelled. and if you notice that many have large cancellation fees if you leave the contract, and that is even before you come to the us. or go to any other country.

please take the time to do a search on the agencies that you are considering. if the offer sounds too good to be true, compared to others in the are, then it is.

have seen agencies not live up to their promises, as well as those that follow every promise exactly.

if you have any doubts, check with the us embassy where you are. they are very aware of what is going on with some agencies.............but do not sign until you have valid information in front of you.

and if any agency guarantees approval in a certain number of days: run

no one has any control over what uscis can and will do, and they can't make a promise that will be met. right now, the retrogression is in place, and nothing past the i-140 is getting approved. not one thing, no matter what they tell you.

I will be working in a Nursing Home either in NJ or NY. Presently, I already have a CGFNS Certificate, IELTS, Visa Screen plus I have already passed my NCLEX last January thanks to your help. One reason why I signed up with this agency is that before retrogression, most of my co-workers were able to go to the US within a year of waiting. All of them have a positive working experience with our agency there and they were really supportive to them Another thing, before I was able to get a tourist visa (and I tell you I really did not expect this and was just trying my luck because one thing for sure is that they are very strict in issuing a US tourist visa here in Manila), I had already signed up with this agency. Prior to signing up, I already have a CGFNS certificate, IELTS and Visa Screen.

Nursing home and you will have thirty to sixty patients that you will be legally responsible for each and every shift. Never a good thing for a new nurse to the US. Highest chance of losing a license.

Which state did you get licensed in? Are you aware that there is a completely different procedure for each of those two states? NY actually requires the CVS, and NJ requires the CES?

I used NJ BON when I took my NCLEX. Presently, I have my CVS being processed just in case I change my mind and eventually want to work in NY since my bestfriend is staying there. My agency is already well aware that I want to settle in NJ. Sorry for the confusion regarding my profile. I'll change it as soon as possible. One more thing, any suggestion just in case they decide to cancel my contract? Does that mean I have to start the application process all over again? Thanks for being such a big help, Suzanne! If you cancel, yes, you need to start the process all over again. The I-140s are employer specific. If the contract with that employer is cancelled, then the I-140 is cancelled as well.

You may have heard that I-140 is transferable, that does not work when the nurse is not going thru the AOS process. And there are also certain requirements for that to be met. Does not routinely get done.

But with Consular Processing, no chance of it.

Check with the POEA Database. One way to check on the credibility of a recruitment agency in the Philippines is if they are registered with the Phil. Overseas Employment Administration ( www.poea.gov.ph ). They work with the Phil. Embassies in the countries that accept Filipino workers and theyre mandate is to protect Filipino workers from illiegal and usurious agencies/ employers.

For US employment ( Even for immigrant visas, if you are petitioned by an "Employer -it falls under their jurisdiction ) they also check that the "Prevailing wage" in the geographic area of your assignment to make sure that what you should get paid is the same as an Equivalent US RN.

The POEA has closed down some agencies and even Have arrested American HR recruiters for not complying with Philippine law. They are a Phil. Govt. agency (AND SO they are Not Perfect..is Any Govt. agency?) and I think they do what they can to protect the 'working class' in pursuit of opportunities.

Unfortunately, not all follow those rules. And some use the license of others. Do your homework first, not after you sign a contract. If it is not in the contract then it does not exist. Even if it was written on a flyer that you were given, if not in black and white in the contract, it will not be honored. And there are those here that are finding that out.

Agencies that give you an updated contract to sign just before your interview need to have that contract approved by US Immigration. Your original I-140 was approved based on that, not this new one that usually has outrageous changes on it, such as cancellation clause from $10,000 to $45,000. Please be very careful with this.

Absolutely right Suzzane! I might add that if there are any 'questionable' or 'manipulative' practices from employers or agencies that you dont feel right about- You can & should file a complaint with the POEA! They work with Phil. labor attache in Washington DC and also in turn gets to US Embassy in Manila as it was explained to me by Atty. Grace of the POEA.

Has anyone heard about Nursing Resource? its a home care nursing specialty based in san francisco bay area. the pay is between $27 to $30, 2years contract. what can you say about this? is working as a home health nurse dangerous?

from reading what suzanne has said plus reading a few other threads when new to the US and their way of nursing you will be looking after a lot of ptients in a care home with lots of paperwork and regulations. Good way to put your license at risk whilst you are getting your bearings of the US way
