After lurking around here for awhile I think its finally time to say hello,

First of all I'd like to say that this forum is a wealth of information, I've used it extensively to help guide me through my nursing school experience.

Now that the introduction is out of the way lets get down to business. I have a situation I would like a little reflection on.

But first a little background info:

I'am a recovering alcoholic who is getting ready to graduate nursing school.

Between 1989 and 1999 I managed to get myself into a lot of trouble: 4 DUIs , a criminal damaging charge and a trespassing charge.

I live in Ohio, were expungment of a DUI is not an option.

I was also arrested and initially charged with a felony, but my case was dropped before I even went to court. I was able to have this incident expunged.

The nursing program I am involved in is a 1+1, first year you're eligible to test for LPN, second year RN.

I mailed my LPN application to the BON with court documents and a written letter explaining how it was, what happened and what I am like now, after 6 weeks I received a letter to inform me that my app had been turn over to the compliance unit and that they would contact me if any additional info was needed. I'm certain that if I am allowed to test, my license will be restricted. No problem, I understand.

But.....after a little researching I've discovered that some states BON are little more...forgiving than Ohio, for instance the North Dakota BON only seems interested in felonies, I was considering withdrawing my Ohio application and applying there, relocation isn't an issue.

Is my plan flawed? Will my record keep me from getting a job regardless of which state I am licensed in?

I say call the ND BON first and verify. Then, if it's not a problem, apply for a ND license and apply for jobs there, if you can afford to move. You gotta do what you gotta do.

My answer is Bite the Bullet. You need to face up to whatever you have gone. Running is only going to get you in more trouble down the road. I believe all states do a complete background check on all licensed professionals. I know Florida does. So, this information is going to be found out by what ever state you apply for. If you try to cheat or be dishonested about some it now, what is going to happen down the road. You made a mistake, now it's time to prove not only to yourself but to the BON that you have changed.

I wish you the best of luck in what ever you do. Just don't cheat yourself out of something.

In response to your query, federal background checks are required so there is no hiding from your history. Also be aware that what is a misdimenor in one state may be a felony in the next. Just like if you have a DUI on your record, you will likely be denied access into Canada as DUI's are felonies that make one ineligible for visas for entry into the country. Personally, unless you desire to live in North Dakota and would be applying for licensure anyway it may be a moot point, plus you will have to self-identify that you applied for a license but referred to the compliance unit in OH when applying to other states.
