Currently on DUI Probation with a recent ADN Degree

Long story short I recently graduated my ADN program (California) in December 2014 and finally convicted of my DUI (BAC 0.15) in March of 2015. I have to serve 112 community service and also put on 3 years probation. I have browsed through a lot of these threads and know that this is a long road ahead of me.

I need some advice on what to do to to be licensed as soon as possible because I feel I will become incompetent with my stuff learned from school over the long period of time. Should I look out of California? Please, any help will do. Before anyone grills me on my poor decision, please know that I wake up every morning and have to look at myself in the mirror knowing that everything I worked for the past 6 years of school is currently going to waste and that I let my family down for my poor decision. But I believe this DUI does not show my character and I am willing to do whatever it takes to get past this. Please, my heart is broken.

California is not a very forgivingstate, and it is one of the worst states to be convicted of a crime in and also trying to get licensed. You could always look into other states but I'm sure that 3 years of probation will definitely follow you to the end of the earth, plus this DUI has happened too recently for anyone to give you a definate answer. I suggest getting yourself a legal lawyer who could help you to at least get your license with just some stipulations and a few restrictions or maybe none. But a license is better than no license.

But definitely look into a lawyer because we're really not allowed to give legal advice on this site...

Anyone know any information about other states? What about Nevada or Texas?

Florida is fairly straight forward.

So if I graduated from a community college in California, how would I go about applying for RN licensure in Florida?

rambo33,

You could do a search for the florida BON and read their instructions. You can apply in any state and take your NCLEX here in California.

I would research several states and make sure you want to move there first.

I am not sure but .15 might be considered an "aggravating circumstance" which could make your outcome worse in Cali. I am not sure if it is .15 or just above .15 (.16 and above) that make it such. I would consult an attorney for guidance.

I wish you nothing but the best! Let us know how it goes...

In California > .15 is aggravating factors so I got the lowest DUI sentencing, >.15-.20 is the next tier up with > .20 being the highest.

If I apply to say Florida and get my license how hard would it be to transfer the license back to california in a few years?

Also anyone have any information about Nevada? I'm looking it up and the information seems so vague.

Word of mouth I heard Oklahoma is one of the most lenient states when it comes to criminal convictions. But im basing this on very scant research.

Florida will ask to receive all of the documents related to your conviction(s) if theyre anywhere in the range of about 3 years. Theyll also want to know if youve completed the terms of your sentencing so im not sure how itll look being on probation for the next 3 years. Chances are they may deny you, or allow you get your license but with provisional terms. Or you may get lucky and they grant you a full license no problem. I know a few people with prior dui convictions and thwy were able to test and get licensed, however their conviction wasnt very recent at all (7-15 years ago)

Get yourself enrolled in AA, and try to get everything done as soon as possible. Theyll want to see that youre taking initiative and doing everything you can to show you made a mistake and youre trying to change for the better, and unfortunately only documentation really proves that.

Good luck
