Audubon also was required to post a notice acknowledging that it violated federal law and pledging not to discipline nurses for union activity, said Kay Tillow, organizer for the Nurses Professional Organization, which backed Gentry's fight.

Tillow and Gentry said the battle was worth waging.

The firing made nurses at Audubon "very fearful of speaking out" about staffing and other issues, Tillow said. She said Gentry's victory shows what can happen if nurses stand together.

yeah!!!!!!! i think that's great! i am so glad to see that hospitals and hcfs in general are being held legally accountable for violating antiretaliation laws. this nurse....lost her job just bc she attempted to utilize her legal right to participate in union activities.she...lost her job.they tried to trump up some bogus reason to "cover up " the real reason for her termination ( to silence her). i think 400k...is not near enough! they attempted to give a bogus/untruthful reason for her termination.....and it was transparent!other nurses at that hospital had done far far worse things that some actually resulted in negative effects on patients and most of them they didnt even write up......but this nurse ...they fired her bc she "flushed " an iv line with saline....like all nurses do before they hang antibiotics or anything to check for patency.they fired her....she and her family lost health ins , dental ins, disability ins, emotional duress....i think 400k is almost letting that hospital get off too lightly for everything they did to this lady! does anyone know why.....her settlement was limited to such a low amt (imo) for all the heartache and emotional duress....and the negative finanicial impact..they placed this nurse and her family through?hospitals need to wake up....bc....this is reflective of todays current trends. juries.....arent tolerating this behavoir from hcf corporates!but...i still feel like the settlement she received was too low for the turmoil they placed her in...and they even tried to file a complaint against her nsg liscence.omg!

while i am happy that this woman won her case, i also feel that she was robbed. she should have been not have been awarded anything less than a million dollars. i would like to know who her attorney was. she deserved compensation for her lost wages, retirement, medical costs from losing her insurance, etc, prorated from the date of her dismssal, emotional duress, in fact she should have been compensated for every penny that she lost over the years that this was going on, and then some. this was probably a very conservative jury in an anti union state, with "right to work" laws.

ladies, and gentlemen, if you are attempting to organize, or just "rattle a few cages", learn to practice, "defensive employment" before your plans become known to the administrators. it will make you attorney's life alot easier, and give him/her more to work with to defend you. i should write a book on the subject.

lindarn.......you are exactly right! she was robbed! when hcf's attempt to place themselves above the state's antiretaliation laws they should face stiffer fines/penalties. these are "people" for god's sake...nurses...who are just trying to exercise their legal rights. this nurse....she did nothing wrong.....other nurses at that same hospital had done many things that greatly negatively impacted a patient possibly ...longterm effects....and they were not fired...not written up etc etc .but this nurse....in an obvious attempt to silence her effort to participate in legally protected act...they terminated her. as nurses ...we should fully appreciate what that did to this nurse and her family. the unneccessary emotional trauma that they placed this nurse through is incompensable.....but 400k i too agree is not near enough.how did that impact her family, her finicial obligations,...her children...her peace of mind? they took away her and her families life ins, dental ins, educational benefits, health ins, retirement/pension, her sense of security she had with this job,.....they took that away from her in an illegal retaliatory act.they should be ashamed.....but these hcf giants are not....and that.......that....just is not ethically , morally, or legally right folks.i agree this is too low of a settlement...but i honestly am glad that more and more of these hcf's are being held legally accountable when they do violate antiretaliation laws. so i have to add "ditto" to your comments!

She deserved more, I agree. I believe that being a nurse is more than a profession, it becomes part of who we are, embedded in how we feel about ourselves and and, more importantly, how we identify ourselves. To try to take that away from someone unjustly, (and then claim that it's oversomething like flushing a line with saline, when we all know that there are nurses out there with their hands in the narc cabinet) is harassment, and she deserves compensation for pain and suffering in the millions. But, like I said, it's the small victories; A single spark can start a fire. Hospitals better heed that case as a warning. We aren't lying down and taking it anymore!

dukern.....i think we could be friends!lol it seems you and i have the same sentiment here. when you said " to try to take something away from someone unjustly is harrassment".....in situations like this that speaks volumes to me.we all put so much of "ourselves" into our jobs.....and when a nurse is fired...to effectively silence him/her in retaliation ...it is just wrong in so many ways. it is morally wrong...it is ethically wrong....and last but not least it is quite legally wrong.so...a small victory "yes"...but the main issue is the trend. the "trend" is that these hcf's are not fooling anyone ...esp the courts and the public. it is almost good in one way...in a time of such a nsg shortage when these cases are made public it gives nurses the "heads up" about where they "dont" want to apply to.:nono:
