Marry before being an immigrant


Hello everybody! I'm a nurse in the Phil and is now processing for my immigrant visa. I got my I-140 approved now. Now, I'm getting married.My question is, my status in my I-140 was single. Can my fiance be able to go with me in the US?


i need inputs..please help me.

I think you have some options.
First of all, I 140 is employer petition and DS 230/ I 485 is the applicant petition. So I dont think your marital status in I 140 is important.
Also, there is something called 'Follow To Join' which, I assume, you are eligible to file for your wouldbe before the GC approval.

Well, unfortunately you need a lawyer to know/verify all your options.

But make sure you act on it fast, because you need to do something before your GC approval. Once your GC got approved, your wouldbe can join you only after you becoming a citizen (6 years ?)

If you get married before your green card application is approved, you will be able to add your Spouse to your green card application. So that the immigration papers will get processed together for both you and your spouse. I-140 application is only for you, so it does not matter if you are married or not. If you did not add your spouse's green card application, while your's is pending, the immigration process for your spouse will take 3-4 years. This is just my understanding, please consult with your lawyer for more information.

Ask your agency's lawyer to include your spouse name after you got married and provide them with valid marrage contract. In case you got pregnant during the processing/waiting time, you could also include the baby, just write under children/dependent "baby is on the way" Goodluck. zuriel
