i am a nurse from the philippines, i had graduated from a master's degree from a university here. i'd like to ask if my employer could petition me for an EB-2 visa. i have a pending EB-3 petition as of this date. can anyone give advice regarding this matter? thank you.:typing

Actually no. The EB-2 is for those that obtained Master's degrees in the US as a start or have significant work experience in their field. Also assume that you were hired as a bedside nurse, there is not one facility that requires the Master's as entry level for this job.

Next is that when they want the Master's for entry level in the US, it is normally of those that hold the Nurse Practitioner Certification as well as additional licensure from the state, or for the Clinical Nurse Specialist role and that requires additional requirements for licensure as well from the state. When training in your country for the Master's, it does not meet the requirements for advanced standing with any BON in the US.

Working in your country as an RN is quite different from that of the US as well just for a start.

What type of Master's degree did you actually get to begin with? What was your area of study?

Also add into the fact that there are many MSNs here that have been laid off from their jobs, and the facility would need to prove that they were unable to hire an American for that particular role that will also make it even harder. There are actually quite a few MSN trained nurses here that are actually working as bedside nurses since they were unable to find work with Advanced Practice training in their locale.

i earned a Master of Arts in Nursing major in Clinical Supervision. i have a contract with a nursing home in Delaware. my employer's lawyer said i need to contact the employer/Nurse Recruiter, which hasn't responded yet about the query i sent.

That is not a job that requires a master's degree to begin with in a nursing home, so the EB-2 would not apply to that.

I heard you said that NP's are under EB-2. My situation is that I am a BSN senior year nursing student in a US University GOING ONTO MSN Family Nurse Practitioner program in the fall 2009. After I graduate and apply for an NP job in a rural setting, will I be able to qualify under the EB-2? What is the different of waiting time/duration between the EB-2s and EB-3s? Is it faster or the same?

It all depends on which country you was born in and what the current VB says at the time you complete your training and whether you find a employer willing to petition you on EB2

If im born from Malaysia, and about the Visa Bulletin, give me an example of how the VB and the being "current" works?

VB is found here http://travel.state.gov/visa/frvi/bulletin/bulletin_1360.html and you just need to scroll down to EB3 and that will tell you what is currently being processed. If current usually has a C in the column which means if you file in that time then you will be processed. If the date says 1st Jan 06 then any applications filed before that date will be processed and nothing after.

Hi! I just want to revive issue about EB2 category for foreign nurses specifically Filipino Nurses. Lately my US agency has contacted me enquiring if I am willing to process under Eb2 visa which is current for Philippines unlike Eb3 which is years retrogressed. (I have Eb3 application with this agency with priority date Jan 2010..and can not wait for the long queue..i guess)

The Eb2 offer letter states that it is for Nurses with masteral degree, or nurses with Bachelor's degree plus above 5 years nursing experience (deemed equivalent of a master's degree) of which this is the category where I belonged. They didn't mention the area of speciality..I guess they are not after of this as it's not mention though....I am a Neonatal Nurse (NICU-stepdown).

There are expenses to incur...but I won't mind if they think I'm qualified for this. But I'm becoming fussy...because I dont want to shell out the initial payment and then being denied.

Does anyone of you out there who has gone through same situation of mine? I'm really confused whether to grab this one or not. Though I want to gamble and try my luck....

The EB2 has nothing to do with the nurse themself, apart from the fact that it requires an advanced degree. In order to apply for a visa in the EB2 category, the JOB itself must require a masters degree as a minimum entry, which any RN position does not. Therefore, if you're an RN applying for an RN job, you are NOT eligible for EB2 category, regardless of your education, because there are NO RN positions that require a masters degree as a minimum entry.

The only way you could possibly do it is if you were an advanced practice nurse ie. Nurse practitioner. Even then, every US state I know of requires that you did a certain percentage of your APN clinical placements in the US, so immigrating as an NP would be tricky.

I have no doubt that companies scam the system by twisting the requirements and paperwork, but be careful - you're the one who gets deported if your case is audited once you're in the US.

Thanks!!!... dont know why they have offered this to few of their nurses with more than 5 years working experience..Infact they even suggest to go there on Tourist visa so they can apply Eb2 simultaneuosly with Status adjustment.
