i work on a Rehab unit in NY , our pt's eat in a dining room . a RN started discussing to me out loud with all the patients were around , why mr X's staples were not taken out the day before.? i said to him please don't discuss that in the dining room take me aside , this was not the place to discuss this patient. he proceeded to keep talking about it and got loud with me in the dining room as to why mr X's staples were not taken out. every pt in the dining room ( our dining room seats 30 ) on and on about this pt's staples the patient and his wife were also present along with the man other residents. he was loud and obnixous and acted like a bully about these stupid staples. i told him to call the doc and have them taken out no big deal but he kept it up . i spoke to ****** our unit manager and told her i midas ******* for a HIPPA violation and for talking back to me ( i am the charge nurse over the unit. ) was this a HIPPA violation ? we have had trouble with ***** having a attuide before , he gets really mean to to other nurses and treats them horrible. thank you in advance for any advice.

First it's HIPAA not HIPPA but yes if he used that patients name and medical information was distributed in the dinning room it is HIPAA.

Second if you are charge it is insubordination.

does anyone know how to correct my HIPAA spelling FAUX PAS ? I tried to correct it but couldn't.. i'm sorry about spelling it wrong. i have had a rough week and i am exhausted. i couldn't believe he did this in the dining room in front of almost every patient on the unit.he does these things alot esp to me. i must be easy to bully i am a nice person one of the other charge nurses told me i had better start standing up to him . so i told him out of the hearing of the patients .. do not ever talk to me like that again... it's like he challenges me .. he told me it was a cultural thing.. i told him no more than i wrote him up for the HIPAA violation and also what he said to me in front of the patients. he dosen't know i wrote him up ... thank you for your support i need all i can get ... when he comes on my stomach turns into a knot.

why do i let him do this to me?? why does he feel he can ? no other nurse onthe unit does this but him ... ughhhhhh he just appears to be a angry person ...

I answered your other post (for which you gave fewer details). If this is as you describe, it could be a HIPAA violation. If he does this sort of thing routinely (the insubordination part included) firing might be in his future.

A cultural thing???? A cultural thing??? What a lame excuse for being a butt head. I have plenty to say but I need to moderate it for the forum.

Sounds to me like he has a inferiority complex. Any one who has to prance about like a randy goat has issues with self esteem. Remind him that while that may be his "culture".... while he is at work and you are in charge it is the work culture that will guide his behavior. Let him know that further acts of aggression will be dealt with in the appropriate channels and he will be written up for insubordination and unprofessional conduct.

NO need to correct it...now you know. It is a pet peeve of mine...:shy:. I correct people ALL the time....even senior admin.

for what it's worth for anyone, if you even THINK it could be a violation, JUST DON'T DO IT
