you can consider this thread as closed since information posted here became obsolete on may 11 2005, once president george w bush signed the apropriations bill in to a law to make additional 50,000 visas available for nurses. this thread was started on dec 11 2004 when the worst news hit rn community that the pd dates have been retrogressed to jan 2002 and nurses will be the hardest hit.

now its official.

pd dates for eb3 cases from india,china, philippines retrogress to jan 2002.

this is worst news for the rn community who wish to migrate to us.

this means that, rns who are already in us will not be able to file i485 (aos) after dec 31 2004 till the priority dates become current. its not clear how long it will take.

those who have managed to file aos will have a huuuuuuuuuge waiting time for their gc apporval.

those who are outside us, will have a loooooooong wait

for someone who is in us and has either cgfns/ncelx (with or without visascreen), the only option is to get an employer to file for i140 and 485 before dec 31 2004. this will make them eligible for ead and legal status in us.

considering the rn shortage, there are chances that they may introduce a new visa category or an exception for nurses. depends on how hard the empoyers lobby the congress.

It doesn't matter what she wanted to do or not to do. The posting was copied from another site, and it did not provide the link as to where it came from nor mention the author, etc. This is US Federal Copyright Law, and is also mandated on this website under the TOS, that everyone agreed to follow when they joined.

This is the H.R. 1268. I read the entire document but there was nothing about Retrogression....

Please try to get some info....

I just got a voice call from one of my reliable source in Washington that President Bush has already signed the Iraqi Bill which makes it officially a LAW as of today...

This is good news for nurses and pt's...But let me remind you all even this is a law...The change would not happen in 24 hours...it could even take weeks or months before the Department of State and the USCIS issues memos to their regional directors and consulates abroad on how to handle Schedule A cases.

My advise to all awaiting is to be prepared completely and documentarily and keep in touch in any news that might take place...

The retrogression is still on and will be on for some time. 50,000 visas are not going to cover all that have their documents already submitted. Do the math. 50,000 will actually only cover about 10,000 to 15,000 nurses because it also includes immediate family members in the number. Look at how many are in the process already just from one country........and increase that to cover 3 very large countries. And the current date is still in 2002.

The bill only authorizes 50,000 visas to be released. It doesn't specify when immigration is required to act on them.

This is what I have been trying to explain to you all along, just because these visas will become available, things aren't going to change overnight.

Nothing to be shocked, if you had known how things happened with USCIS before. Thats why it was previously mentioned as reply to your concern that REALISTICALLY PD would not be current on May 15 Bulletin, though anyone had every right to be optmisitc.

Hold on for another 30 days. You should be fine. PD will be current!

Retrogression for Nurses be lifted soon (on July 1). As Immi. lawyer Shusterman accurately predicts, newly alloted visas will insure supply of RNs for next 3 to 4 years. Read more about this on another thread (BEST news...)

Visa Bulletin for June just got published Today (Friday, May 13 around 2:30 PM CST) not on May 10.

I think you are in a far better position than myself with the only exception that you are doing CP while I am doing AOS.

About my immigration journey:

I sneaked in my papers just before the retrogression got started. I dint have my VS when I submitted my papers. Since USCIS does not require VS to be submitted while filing our papers, things worked fine. Got my EAD approval within 3 weeks (without Visa Screen). I am expecting an RFE for VS when they look at my AOS aplication.

Though there are so many websites there about immigration, shusterman is the one I rely for information. And his bulletin is a great source of information for all nurses.

[9000 passed cgfns in 2003 and 2004 assuming that same 9000 passed in 2002/since june 2002 to now ther must be 27000 rns in que /but this figure goes down by maybe half if we take all the exams ielts and visa screen etc/so we hava rough fig of 13500 /that is approx the amount of visas sanctioneD factoring the family NEEDS 2 VISAS EXTRA PER FAMILY /plus dont forget the share in the normal 40000 per year /CHINA SURPRISINGLY HAS VERY FEW CGFNS PASSERS HARDLY A FEW PERCENT CF INDIA 40 PERCENT PHILL 55 PERCENT OF THE TOTAL//GOOD DAY
