Worst news for RNs from India, Philippines and China

you can consider this thread as closed since information posted here became obsolete on may 11 2005, once president george w bush signed the apropriations bill in to a law to make additional 50,000 visas available for nurses. this thread was started on dec 11 2004 when the worst news hit rn community that the pd dates have been retrogressed to jan 2002 and nurses will be the hardest hit.

now its official.

pd dates for eb3 cases from india,china, philippines retrogress to jan 2002.

this is worst news for the rn community who wish to migrate to us.

this means that, rns who are already in us will not be able to file i485 (aos) after dec 31 2004 till the priority dates become current. its not clear how long it will take.

those who have managed to file aos will have a huuuuuuuuuge waiting time for their gc apporval.

those who are outside us, will have a loooooooong wait

for someone who is in us and has either cgfns/ncelx (with or without visascreen), the only option is to get an employer to file for i140 and 485 before dec 31 2004. this will make them eligible for ead and legal status in us.

considering the rn shortage, there are chances that they may introduce a new visa category or an exception for nurses. depends on how hard the empoyers lobby the congress.

What is Real ID Act? Is there anything to do with EB3 Retrogression???

I saw some articles about it in shusterman.com. If any1 know about it please explain.

Read that posting closely from Shusterman.........It is talking about the H-2B visas..........this is a temporary visa, not a permanent one. And many come with stipulations that they cannot be renewed..........It is not speaking of green cards..............BIG DIFFERENCE! Any of the H-_ visas are only temorary work visas.........Be aware that if you accept one and do not liek the facility where you are at, you will have only x number of days to find another sponsor or you will have to leave the US. Second thing is that hospitals and agencies are not required to pay the same wages to the temporary employees, only permanent residents......So please be very areful with this, if you choose it. My suggestion is to wait until the retrogression is lifted and do things properly. But it is your choice.

They still have the same requirements as that of a green card, and you must have the Visa Screen Certificate in hand before your documents can be processed.

this is not true!

shusterman's ticker mentions about h2b visa and the permanent resident visa in the same sentence. here is the wording :

"the exemption to the h-2b cap was

included in the final bill as was an

amendment providing additional visas

for those working in schedule a

occupations (registered nurses and

physical therapists) "

to be more specific, h2b thing and the recapture of unused immigrant eb3 visa are two different amendments. h2b thing is the mikulski amendment and recapturing unused eb3 visas is the hutchison amendment.

All of you need to take a breather and a step back..........

First, 50,000 visas cover the nurse as well as her /hisfamily, that means spouses and children count in that number, if they are going over with them.

There are 5 offices that process for green cards in the US.............only five offices..............there is no way that they are going to go thru that number in just a few weeks.........it just isn't humanly feasable.

Believe me, I want you over here just as much as you want to be, and spend long hours helping many of you.........but you need to be realistic.......there are already piles of applications that have been sitting there since before January, and those will get priority over those being submitted since the retrogression...............

I just don't want you to think that things will completely change overnight, even if the retrogresion is lifted tomorrw, and start quitting your jobs that you are using to support your families right now.........it is still going to take months, if not years for many of you. As I said before, even if you look at the nurses from the UK and read their threads, many have been waiting for more than two years, at least the ones going thru agencies.......and they only needed NCLEX and Visa Screen....no English exams required for them.

Remember that many of you are being placed in California, that has a two year wait in even good times..............so just please be patient, and you will appreciate things even more.......... :)
