I applied for a cna job with a hospital. The application only asked "Are you currently excluded, suspended, debarred or otherwise ineligible to participate in the Federal health care programs, or have you been convicted of a criminal offense related to the provision of health care items or services but not yet been excluded, debarred, or otherwise declared ineligible?" to which I answered no. I have a felony conviction in 2013 for making a false statement to a federal officer but it was a matter involving the ATF in regards to a business my husband was operating. From what I've checked this doesn't constitute exclusion from federal health care programs. Criminal background check was not brought up during my interviews and now I have been offered the position. I'm worried about the background check of course because I know what will be on it but since it was not brought up in my interviews I also did not bring it up. I am not trying to hide anything and have no problem discussing the circumstances of this conviction. I have approval from the TXBON for NCLEX testing. Should I bring up this convction when I speak to the recruiter for the hospital again or should I just keep quiet and hope for the best?

You have to answer the question clearly. If the felony conviction you have involves healthcare the answer to the question is 'Yes.' Did you have a lawyer? You can seek their advice. Honesty is usually the best policy, if the employer finds out and you did not disclose that can be considered deceptive and the offer might be withdrawn.
