Aloha!!!well, I'm one of the phil.Rns with an agency locally.They have filed for an EB3 visa on my behalf..I have been informed that my status is now at packet 3..which is one more step away and I would be done with the immigration process.Now,I and my colleagues with the same agency have been caught with this retrogression..Does anyone here have the same status as mine?Do you know when the retrogression lifts up again?I have been waiting for 3 years now..its a pain in the ___ to wait..and one thing....our agency also is one of our problem..i cant talk about it here..hmmmmmm...:uhoh3:

how come you have been waiting 3 years?? you should have been sorted long time ago. When did you pass NCLEX and when was I140 approved? Doesn't sound right!! but guess you have had problems with your agency

There are a lot of nurses stuck some at packet 4 (file complete just waiting for interview) some have only just gotten their I140 approved where as others are still waiting for approval. No telling when retrogression will lift but check out the threads on it in the International forum

Tnx Siverdragon...my I140 has been approved and my priority date is june 24,2005. I have been caught under retrogression for three times now..I don't know what to do to expedite the whole process...:o

sorry but it still doesn't sound right. If your PD is June 05 then there must have been some problems as retrogression restarted in Oct 06 and even with the retrogression in 05 your agency should have still recieved something I would have thought in 05 or beginning of 06

There is nothing you can do to expediate the process, it is a case of wait for visa

When was your I-140 actually approved, that would help us make more sense of things. This is the second retrogression and has been in place since last October, so not sure how you have come up with three in the time that you been under processing.

Until the I-140 is actually accepted, then there is no bill generated, and no fee paid, and then no DS-230 sent out. Somewhere there a hold-up in your paperwork for some reason or another. If you had approval in early part of 2006, you would have been done with your petitions by now. Seems like there were issues with the initial I-140? Am I correct on this?

If you applied in 2005, and are just getting to DS-230, definitely a problem with the agency or the attorney. There was a major delay there and suggest that you follow up with them. Has your visa bill been paid and when ?

Yes,,definitely there was a problem with our immigration attorney and even with our agency representative.

At the moment they are into settling with the arbitration committee. And lately, I just heard we have a new immigration attorney.

You cant just imagine too that our agency is holding our documents. They won't release it unless we pay the amount they've spent for us from the time of application (exam fee, reimbursements,etc)

I cant believe agencies like this exists...We are now directly communicating our concerns to our new attorney but they can't do anything else cos it is still retrogression.

Some of my colleagues who signed a contract with other agency are now in the US. Their priority date was July 2005. mine is june 2005 yet am still here in the my homeland.. lol

well,,,,God might have a better plan to all of us who are in this situation..

BTW, my visa bill was paid january of last year...2006.

I understand your frustration but please be aware that there is no longer any guarantee that you will actually get the green card for the US at this point. There are now many more applicants than there are visas per year. And if ther were problems with your agency in the past, getting a new attorney is not going to fix things or get things expedited for you. Actually, it still makes things look even worse for you.

There are some agencies that Us immigration is not approving visas for due to issues that have happened in the past, not sure which agency that you signed with. But if three years, then there are many more problems that are there.

And if you had to go into arbitration because of immigration issues or issues with the agency, then that is not a good thing in any form at all. And makes things worse for you at this point in time.

Tnx again...yeah me and my co-applicants knew the legal consequences that's why we didn't join their legal battle between our employer and our agency/immigrant atty.

DO u think it would be better off for me to go abroad rather than waiting here in the Philippines with this kind of retrogression status? I have been waiting for 3 years now...I'm totally lost on my next steps..what if I get to other country and tied to a contract then my US applicantion then comes in...argghhh Its really frustrating..

BTW, I love this site...You moderators are doing a great job and you are helping a lot of NURSES in the whole wide world..Keep it up!
