tbon investigation letter

in august I was accused by a coworker to my manager to be under the influence because I had a twig in my hair and stumbled. I refused to drug test and went home. I continue and still remain employed elsewhere but have received a letter of investigation. after 24 years of being spotless and being successful as I nurse I have this all because wacky jacky wants to go around accusing people she don't like of being less than a nurse. I felt relieved after walking out that day but now It may come to haunt me. Im not sure what to expect after submitting my rebuttal in writing. I am on a compact license working in Texas to add. No I don't have but will get some. I do have God telling me not to worry but the human in me wants to hear from others who have been in my shoes

My lawyer received a reply from TBON and the case has been dismissed. To all others that are saying by refusing drug test and standing up for my truth that I would be guilty and that the board is unfair I must say you are definitely wrong. It was unfounded and God definitely stood by my side through this awful mess. To others that are going through an investigation and have done nothing wrong have faith. It almost took a year but I MADE IT WITH MY LICENSE INTACT AND CLEAN. Thank you

In my circle, yes, know of a few who have refused drug tests and landed in monitoring. Innocent? Hard to say, only they know the truth.

You are very fortunate! I assume that their investigation showed no discrepancies in documentation, and that saved you. But imagine if you had forgotten to document a waste at some point? Or if you had overrode a narcotic in an emergent situation? That could have changed everything. Also, who is to say that some street drug was not being used? Hospital records would not show any of that. This is where their minds typically go, and 99 times out of 100 they err on the side of caution and place the nurse in monitoring, even if it is just for a year, to be safe. And yes, I do know nurses to whom this has happened. This is why refusing a screen typically goes poorly. Their minds go where ours did - why wouldn't an innocent person want to prove their innocence?

I had the EXACT same thing happen to me. I just got my letter. I refused the test because I didn't appreciate the way they came at me. I got fired. I have since passed 2 other pre-employment test with a staffing agency and my new full time job. Just got the TBON letter and I need to get a lawyer, stat. Can you please tell me which lawyer to hire, memalicious?? I tried to message you, but it won't let me.

Congratulations! I have known several people to refuse drug test and come out with a dismissal and no marks from the BON. I know some will disagree with me but it’s really what the BON can prove. If you have done nothing wrong, or there is no proof you did something wrong AND you have an attorney it will be extremely hard for them to place you in monitoring. Without an attorney, the BON loves to use intimidation tactics and it most often works in their favor.
