Student Visa & Green Card

I have passed my NCLEX-RN in april 2008. My file is with USCIS since December 2007(through a placement company in US) and I am waiting for the approval. I know immigration is going to take long time. I am diploma holder from India. I want to complete my bachelors in US as instead of waiting for immigration i could pursue my studies and could have better job options later. Please clarify my doubts.

Can i apply for a students visa with appropriate funds to support my fees and living expences (As my case is already with USCIS)

Can my spouse accompany me when I am on student visa

Can I change my student Visa to Green card while I am in US on student visa

Bit confused if your file has been at USCIS since Dec 07 but passed NCLEX 08 how did they file as usually need pass in NCLEX to meet requirements or pass with CGFNS exam?

The decision to whether you can have a student visa depends on the embassy but you will need to provide proof that you can support yourself and spouse before visa is issued and your spouse will not be able to work and you may be able to but usually restricted the first 12 months and not always a guarantee that permission will be given. Once in the US there is currently no way for you to change visa to GC due to retrogression and India processing times at the moment is EB3 = 2001 and if you have a masters the processing times is 2004 with no telling how long it will last (retrogression)

Please be aware that you may not work while on the student visa. And the fact that there are no visas available for you to adjust to. Things are actually moving faster for those that are under the CP processing which is what you are under at this time. You may only work up to 20 hours per week and that does not start when you come to the US, and requires special permission.

The only way that you started the process last winter was that you took and passed the CGFNS exam, it would be the only way to do so.

If you have a look at the wait for a green card, you will see that those from your country are waiting longer than others, this will not change if you come to the US because of the number of applicants from your country, even does not change if you get the MSN as there are many with the Master's training as well.

I would not recommend it at this time, as it is not going to benefit you at all in terms of getting a visa due to the number of applicants in front of you. Your choice.
