Sexually active students

Published

Hi everyone,

I am school nurse at a Middle School and had a student approach me today because she is worried she might be pregnant. Although I've been in school nursing for over 15 yrs, this is a first for me. After our conversation, I doubt if she is pregnant (she's on her period), but she is definitely sexually active. I advised her to talk to her mom about visiting our county health department clinic for testing, info, etc. I told her if she has any problems to let me know and I would give her info on making the appt herself. I know every state is different, (here in IL minors can go to a title x clinic, which is just down the street from my school, without the knowledge or consent of their parents), but I could use some advice as far as confidentiality is concerned. She is 14 and the boy is 17, both minors. Thanks!!!!!!

In CT, I do believe that is considered statuatory rape. Does not matter if the 14 y/o consented...... better check.

ACK! Because of their ages, I would think you would have to report it to someone!

Illinois law....

Aggravated sexual assault for sexual penetration by an offender under age 17 with a victim under age 9.

Predatory criminal sexual assault of a child for sexual penetration by an offender age 17 or older and a victim under 13.

Criminal sexual abuse is sexual penetration with (1) an offender under age 17 and a victim between ages 9 and 17 or (2) a victim between ages 13 and 17 and an offender less than five years older.

Aggravated criminal sexual abuse is sexual penetration with a victim between age 13 and 17 by an offender at least five years older.

Found this too (also under the state of Illinois laws)...

* Criminal Sexual Abuse: person under 17 commits act of sexual penetration or sexual conduct with a person 9 to 16 years of age; or, where person commits act of sexual penetration or sexual conduct with a person at least 13 but under 17 and defendant is less than 5 years older than victim. (Class A Misdemeanor)

This is what I would do:

1) let administration know - (a) talk with counselor, they may have background on the stu or family (b) talk with social worker, if you have one on campus, for same reason as (a), © between admin, counselor, SW, and yourself decide if who is going to call the parent becuase, you have to

2)call child protective - it's the law, you have to

Good Luck!

Ask her if her parents are aware that she is sexually active. If they are aware of the age of the boy, then she has parental consent. If they dont, it needs to be reported.

Better check state law. In some states, a fourteen year old cannot legally give consent.

agreed, that 14 cannot give consent. I would still ask her if her parents are aware and ask her if you can call them
