there are definitely laws relating to these things. i'm posting a link to the medicare laws for ltc (these are the federal laws). you will have to find the state laws for your state. the people who will know what and where you can find them are the certified medical record people, the administrator, don or you can check the website of your state public health department. whatever state agency does your facility surveys will be able to cite the titles and numbers of the specific state laws that apply to you. once you know the numbers of these laws, you can usually find them quite easily online.

  • http://www.cms.hhs.gov/certificationandcomplianc/12_nhs.asp these are the medicare conditions of participation (title 42, section 483 of the federal law) that apply to nursing homes - to view the actual laws nicely listed by subject, click on the "42 cfr part 483" link at the bottom of this web page. read 'em and weep. you will find some of them to be surprisingly very broad. often, a state will come along and add their own law that define them even further. even more so, jcaho will get even more specific when they write the required elements of performance around some of these. welcome to the wonderful world of regulation!

it is not typical for staff nurses to seek out this specific information. however, i want you all to know that it does exist and that it is not secret information. it is available to anyone in the public to view. these are public laws that were passed by our legislative representatives to the u.s. congress and your various state bodies. we should all take the time to read through and be aware of them. they are not that lengthy. knowledge is power.
