query abt immoigration to US(very peculiar)

hello there,

i think this is a very peculiar querry to be asked.let me explain my situation 1st.

i'm not a nurse but my wife is a nurse n she needs to come to us asap. i'm now in india n 've got admit to one univ in texas for ms in engg on a f1 student visa. i learn that i can bring my wife to us on f2 visa(as a dependent). as a nurse she still need to take ielts n nclex/cgfns.she will finish with it in the next 6 months frm india only.afterwards when she applies for the greencard i find that its a timeconsuming process if she does it in india. i learned frm the websites that once she is in us n apply for ajustment of status then she will get a work permit in 90 days(the processing time in india takes abt 1 year). so i plan to bring her to us on f2 visa. then i will try for an employer sponser frm texas for her. then will apply for i140. then will apply for the adjustment of status n the work permit.(i assume that this whole process will take only max 4 months to get the work permit)

now i will ask my doubts one by one.

1. is watever i assumed above correct??(i mean the time taken for the processing n all)

2. i want to know whether she can apply for a change of status while she is in the us on an f2 visa??

3. will i too be getting the greencard on her careoff as i'm her husband??(note that i need it while i'm on f1 visa)

4 whether my plan of getting the greencard n work permit in the us is easier n faster for her or just be there in the india n apply for the green card is easier n faster??

i suggest you check out the international forum, currently there are no visas and you are not able to change status, read the threads on retrogression. she is much better starting the process whilst in india. either way she is applying for licensure and needs to meet requirement for the state board of nursing of foreign trained nurse before she will be allowed to sit nclex. once she begins the process for gc you can be included but before she can adjust status (which may take a long time) she needs to complete everything and have a visa screen certificate in hand. if retrogression lifts you are still looking at several months before you can adjust status. i don't think she can work on f2 but definately can not work as rn until she has completed everything so you may have to show proof of able to support both of you. for texas she will need ces from cgfns and regardless of whether in the us or india the process with cgfns takes several months definately longer than 4 months, and that is as long as they receive the documents with no errors.

Retrogression means no visas therefore if she comes to the US she will have to wait until visas are current before she can apply for adjustment of status (AOS) No telling how long that is going to last. Much better to start the process with the state board of nursing (BON) as the process is going to take over 6 months or even longer before she will get permission to sit NCLEX.

Visa bulletins come out approx 15th of the month and you need to check EB3 for where they are procesing visas but nothing is really going to happen until October at the earliest due to visas all gone for this year and the new year starts October
