Past disciplinary action overturned

Hi All,

I am new to Texas but while in Tennessee, I had to go before the Board of Nursing because of statements that were not true and I entered into the TNPAP program as part of the TNBON findings against me.

The TNBON was found to have not followed the law, (they put me into "the system" without merit" and on appeal my charges were overturned by the Chancellery Court.

I have not been able to find others who won their cases against a BON action and now I am finding that Texas states that any disciplinary action is cause for not issuing my LVN Texas license.

Can I get my Texas LVN license based on the fact that it was found that my charges should never had been brought to the TNBON as no disciplinary event occurred?

I was never restricted on my license and after only a year was released from any TNPAP interactions.

I do not mind explaining this event but as Texas say's "NO prior disciplinary action" would this prevent me from even applying for my license in Texas?

Hello NurseTina55. If you can search for your name on the TNBON website and find no record of your disciplinary action, you should be fine with obtaining a license in Texas however, I think you should contact the TXBON. It is always best to find out from the "pwers that be" determine your eligibility for sure because to say no and it come up; even if overturned in the BONs eyes means you were not being truthful. It is best to be very safe than very sorry later. Hope this helps and I hope you do get your license!
