OVI after NCLEX first attempt

Well I took Nclex Feb 6th in OHIO, I checked the site and it gave me an RN# and so I went out celebrated with family and friends... well 2 days later OBN called me and told me I had failed and it was an administrative error! As you can imagine I was devastated and that I passed! So just started to re study and buckle down to pass this test... I recently just got stopped and refused to take a breathalizer test, which in Ohio is called a refusal. I hadn't drank much, I have an att., it is possible that this OVI charge does get dropped, soooo My question is...... what do I do from here? My test is scheduled before I go to court again... do I have to notify them before i test again? Or just take test and PRAY that it gets dropped?
