Hi All
I'm an LPN in NY State who works for a home healthcare agency. In 2014 I worked 41.5 hr per week without receiving any overtime pay (It adds up over a year). They tell me LPN's are not entitled for overtime pay. Does anyone know if this is legal? Any advice would be appreciated.

Not according to federal law. RNs may qualify as exempt professionals. LPNs do not. Contact state labor board and file a complaint

Yeah that doesn't sound right to me. I have known plenty of HH agencies that pull shady stuff so I would not be suprised if they just made this rule up without knowing if it is legal or not.

HA... Tell them you wil call the labor board and ask them. See how quickly the tune changes.
I had a dispute with an employer. They could not simply not pay me until the next pay, 15 days away. This was after not paying for 30days already. I informed them they were breaking the law and if we could not reach an agreement I would be reporting them to the labor board in 4 hours. 2 hours later they figured out how to cut a check and fixed the pay for all the other nurses they were late on.
