Hey nursing students God Bless You All!

If someone relates to my dilemma OPT- HOSPITAL JOB SPONSORSHIP-GREEN CARD. If someone has gotten trough this long process please give me some idea:innerconfwhat I need to expect. A person from our school got denied December for OPT. Now I am not so positive when I am submitting my papers to INS. Any info will be helpful.

I also would like to know the answer.

well, the only thing i know is that you can only be denied OPT if you have done internship for 12 months straight while in school...or you have worked while in school under the economic hardship scheme...if any of the two stated conditions does not apply to you i don't see the reason why you should be denied...i got my OPT even before the end of my last semester in school...so wishing you, good luck :specs:

Many have posted they received OPT but the issue will be once you have completed OPT and if retrogression is still in progress (highly probably) then there is no way to adjust your status and stay in the US

well ...what they need to do during OPT is to get an institution or agancy to help them file for a H1-B visa and from there they can file for their green card...thats how i got my.good luck!:)

But not many hospitals will file for H1B these days and to get H1B you are supposed to have many qualifications or high experience to meet requirements and newly qualified do not meet these requirements

Please be very aware that just because someone files the H1-B for you, it does not guarantee that it will be approved. We have seen attorneys file this all of the time, knowing full well in advance that it will be denied, but they get paid when it gets submitted, so it does not matter to them.

And the visa must be approved for you to be able to remain in the US, if it is not by the time that your OPT is over, then you have 60 days to leave the US.

It is not a point of getting approval, that is not the issue; but the fact that there are no visas available and we do not expect things to open up before the one year of the OPT is completed.

Does not matter what happened in the past, but we have been under a retrogression since October, 2006 and there was an open window this past summer where they were accepting the I-485 for a short time, and they had more than 800,000 petitions that were submitted and during a time when there were no visas available.

There are only 140,000 green cards issued per year under the EB-3 cateogry and that includes those that are under the CP procedure and some have been waiting more than three years for their visa and they already have everything completed and just waiting for a number. So do not expect anything to come around in the near future. This is what we have been trying to tell you.

However, I think they issue a work permit and one can start working and still wait for his visa even if it takes 5 years. That's my info. If somebody went through the process recently , he/she can gives a good view. Kind of retarded on part of the U.S. government to deny international students that have graduated on the US just because there are no visas since they don't have enough nurses anyways???

Again, what has happened in the past is no longer what is happening now. You are able to use the OPT, and then by the time that the year is up, you would need to have the I-140 submitted, as well as the I-485. And that is where the current problem is, if the US government will not accept the I-485, then one cannot remain in the US as their student visa will be expired. It is only valid for up to 60 days after last day of school, or after the OPT is completed.

Attending school in the US does not guarantee one that they will be able to remain in the US and get a green card. This has not been a done deal for sometime. And attending school in the US does not give one any shortcuts thru anything, all of the same requirements need to be met, the only thing that is waived are the English exams if the initial training was done here.

We do not have work permits here, and that is the point that we are trying to make. You get a one year EAD thru the OPT that permits you to work and that is not renewable. You must be able to get the I-485 submitted to begin the AOS process, or you cannot remain in the US.

You are free to think as you want, but this is what is happening in the US right now.
