NVC now moving?

heard from a friend who's PD is july 04 that she recently got good news from NVC - her case is now eligible for further processing.. isn't that great? finally, nvc is moving... (despite the fact that VB cut-off is nov02)...:cheers: my PD is Oct 05.. does that mean, i can hope that my papers will soon move too?

As far as I know, re-capping of visas usually does not happen at least until the middle to the latter stages of the fiscal year because they have to make sure that those visas are really not going to be used to make it a 'spill-over' as some people are terming it.

There were quite a significant number that got approved (mostly AOS) from mid last year when the PDs started moving forward and finally went current in July.

As far as Consular Processing is concerned, NVC regularly asks for updates and so they have an idea if the case is 'abandoned' or 'inactive' if they get no response from those. Some people with old PDs in CP really do abandon it because it was taking so long while some are in other countries already and there are also a few that do not respond to give updated biographical info and other updates such as updated police clearances, etc.. So, you may also deduct those not responding anymore and take them out of the equation.

However, USCIS also just came out with the 180 day time-limit for the FBI name check and will be now giving GCs to those who filed for AOS with old PDs and are documentarily complete once their PDs become current. This is now added to the equation. There is a total 400,000 that is said to be stuck in the FBI name checks that would otherwise have been given GCs already if not with the lacking FBI name check report. Not sure of the country-by-country breakdown for these but should be added to the equation.

So, in my opinion, there are prob. lesser people waiting in line from older PDs w/c explains the reason why PH has been temporarily separated from India and China and having the same forward movements as from the "other chargeability areas" since the new fiscal year but that can change in the coming VBs depending on some circumstances and factors I've mentioned above.

People will just have to wait for the next few VBs to find out if it will continue to move forward, stay as it is or even retrogress. One thing is for sure, it will not go beyond the July and Aug 2007 PD as there are just too many that filed on those dates.

Actually if we want to be really optimistic, there is a possibility that the cut-off date can touch 2007. The cut-off date actually needs to be at least Jan. 1, 2007 for all the PDs in 2006 to be processed and given visas. If it doesn't reach the 1st qtr of 2007, then that means that there are still quite a few that were hold-overs from 2004-2005 PDs and the first half of 2006 so much so that it exceeds the 10,000 visa (including dependents) country limit for EB3 and the re-capped visas or "spill-overs" will be not enough as well.

It just won't go beyond July-Aug. 2007 and might get stuck on those dates for years if the quota for EB visas would still be 140,000 a year, esp. for some countries.

Another factor I forgot to mention is how many Filipinos filed for AOS in July 2007 from H1B visa with PDs of 2004-2006? This gets added in the equation as well but we already know that it's not the same number as from India or China and more in line with ROW that is why the cut-off dates for PH is the same with them, so far and not the same as from China or India. Also, some H1B holders, believe it or not, missed the window to file for AOS last July and Aug. 2007 and some aren't even aware that there was that window of opportunity last year. Some don't even know that they can file for AOS and content with the H1B visa. So, not all H1B visa holders are in the equation as well.

But to add into this again, notice the disclaimer that they have in the Visa Bulletin this month about what was current on that date around Feb 7th when the Visa Bulletin was prepared, it already states that it expect things to retrogress and soon.

Unfortunately, there are many that have applied for the green card in the past year or so from your country, so that is going to decrease the odds of getting a green card in the first place. So that is why I keep pushing for everyone to get some type of experience.
