Hi I'm not sure if this is the right category if not could someone point me there? Thanks
I spoke with a recruiter about a ft pca position. She informed me that pca's do not get paid 1.5x rate for optional ot, ot pay is only granted by being requested by staff. This sounds crazy and I've never heard of this. I've googled this topic and I've found different things but not the answer I'm looking for. Dept of labor say anything over 40 is 1.5x and another employer I've spoken to told me the same. Could this recruiter be wrong or is the hospital cheating pca's?

Federal law states unless you are exempt (salaried) employee, you must be paid at 1.5 of your regular hour rate. She is wrong.

Is there a union in the facility? If there is, I would speak with them about it.
What you may find is that if a member of the staff (and usually the charge nurse) asks if you would stay to help over the end of your shift, you will probably be told that you need to come in late or leave early on another day within the same pay period.
It seems to me to be an unclear way of saying that your schedule can be changed to suit the needs of the unit. And that you may have to stay over the time of your shift, but it will not be overtime, as they accommodate another time off.
