Hi yekta,
We are also in the same situation like you. My wife (on H4) passed RN last week from Vermont. Now we applied to transfer to Georgia( She have TAX ID).
We are living in Norcross. GA. Can I know that how you are proceeding furthur. We are thinking of filing for H1B or GC.
Please reply.
It does not matter what you want her to do, the fact is that there are no visas available for her to adjust to. The green card is not going to happen in any time soon.
H1-B visas are severely restricted when you can find them for a start. They require a BSN or at least training that has been classified the same as that, and depending on the country where she trained, most programs are not going to be the same as the four year BSN that we have here.
The US government is not accepting any visas to adjust one's status, and has not been for close to 16 months or so. There are already more than 800,000 that got their petitions in when there was that short lived opening and none of them have received green cards as of yet. So do not expect anything to open for at least five years based just on those numbers. You need an employer before you can have anything started as far as immigration. It is never started by the nurse. Other issue before you spend all of this money is to understand that chances are that she will not get permission to work before your H1-B is expired. They are only for three years and can only be renewed one time.
One must also possess a Visa Screen Certificate in hand as well for any type of visa, and not sure if your wife has done that.
Having a tax ID still does not permit her to work, she needs a specific visa that will permit it. Also be aware that Georgia requires the CES be completed even before they will look at any application.
I would most definitely take the time to do some reading on this site concerning the retrogression and how it is going to affect her directly.
Best of luck to you.
My husband is a fellow in Oncology and university is going to hire him and apply for green card for both of us, Do you think they will get it for us or getting a green card effects on doctor as well.
I believe that if your husband is a research fellow and he has a good bakground in research with several published papers then he may qualify for GC EB1 (no backlog)The universitys immigration attorneys will probably be very familiar with GC applications for clinical fellows.
Otherwise he will qualify for EB2, for which there is no backlog for your country.
I am not sure if labor certification will be required for your husbands application. If it is then that can take around a year.
It's GC EB3 category that's backlogged.
Your nurse training in Iran may be equivalent to a BSN in the US.
I trained in the UK and did a 3 year certificate RN training , but have further training and 23 years experience and that was equated to a BSN.
If it was then you would qualify for H1b work visa, provided you could secure an RN job that required a BSN
Usually the applications for H1bs reach the 65,000 limit on April 1st each year, but both this year and last year that didn't happen.
Type of jobs that may require BSN include unit managers, education jobs and some research nursing posts.
