Need Advice as what to do ?

Published

I am an American and my fiance is in the Philippines and is in nursing school there and will finish in May. She says when she is finished she has to take a board exam(not sure what that is)I want to get her over here as soon as possible(Virginia) and wanted to help her get things started for her nursing career here. Not sure what she will need to do as far as taking any tests here, if she has a waiting period, or even how hard it will be to get a job here, and whether or not her credentials will be valid here. I have several fiends who are nurses and they tell me that they are in such shortage of nurses here that it is easy to get a job but not sure if that applies to my fiance since she is going to school abroad. We will be getting married later this year so dont know if that will help or not.

Sorry for being so naive about this but just wanted to do what I can to help give her a good start. Any advice would be greatly appreciated.

You will file for K1 Visa (aka Fiance Visa). Once you are approved (60 to 90 days on average), you can then call the US Embassy in Manila and schedule her interview. After passing interview (the actual interview last less than 5 minutes most of times) they will approve her for a Visa and send it to her via a Visa delivery service within 7 days.

She has 6 months to use her K1 Visa, Once she enters USA you must be married within 90 days.

If you want to speed up her being able to work, then marry as soon as possible and then you can send in her AOS (Adjustment of Status), EAD (Empolyee Authorization Document - This will allow her to work), AP (Advance Parole - this will allow her to leave USA and re enter while waiting on approval of AOS)

AOS and AP are usaully approved in about 60 days and sent via mail without a interview.

So I would say you are looking at 4 to 7 months before she has a approval to work in USA.

There is website called Visajourney.com and it has sample forms for filing your paperwork and it has a forum that is good for additional help.

As a rule using a lawyer is waste of time and sometimes slows the process due to mistakes they make.

Filing a K1 Visa is easy, and you just need to follow directions on the paperwork

Good luck, you can PM me and shoot me your number and I can go into more detail over the phone

Good Luck

NCLEX will need to be sat and passed as well as meet state nursing board requirements before she can work as a nurse in the US. She can start the process once she has graduated from school and generally looking at 4-6 months before she gets eligibility to sit the exam.
