LVN on probation needing malpractice insurance.

Hello there,

I'm currently an LVN. I was arrested in 2009 for possession of a controlled substance. I complied with all court requirements and my case was dismissed. BVNPT placed my license on 3 years probation on 2/20/2014. I am currently in the RN program about to start clinical rotations. In order to do so, I need to have . NSO has already denied me coverage since my probation is active. I've called multiple companies without luck. Does anyone know of a company who will provide insurance while being on probation? I'm desperate. I need coverage before next Tuesday 8/11/15. Thank you.

I'm sorry, I don't know what to tell you. Honestly, I think you might have a real problem with getting an RN license at LEAST until your LPN probation time is up. I wouldn't think you'd be issued one before the end of February 2017 at a minimum. If your program is long, maybe not a problem....if you are getting credit for having a PN license and will finish the RN program in a year....you might have to wait awhile after graduation to apply.

I am afraid you might be out of luck. NSO is the insurance agent for CNA, and current licensure sanctions generally are grounds for the CNA underwriters to decline the application. ProLiability is the insurance agent for Liberty Mutual, and they follow the same guidelines. CNA and Liberty Mutual are the two dominant nursing insurance malpractice companies. You will probably need to go to the 'non-standard' or 'high-risk' market, and off-hand, I don't know if that exists for nurses. The Philadelphia Insurance company writes a small amount of malpractice insurance for various healthcare providers in the 'non-standard' market, although I don't know if they do so for nurses. Most companies deal with the issue by declining to write coverage for nurses in the 'non-standard' market, as you have seen.

If you have a personal insurance agent or broker, call them, describe your problem, and ask if there is a 'non-standard' carrier that would be willing to write you, or can they refer you to a specialty (healthcare professional liability) agent or broker that might know of such a carrier. Be advised, in the small chance that you can find such a carrier, they will be charging you a lot for coverage.

As pointed out before, you may not even be allowed RN licensure until,at minimum, after your probation is up. And even then, you may have restrictions placed for some amount of time based what the probation was originally for. Furthermore, many clinical facilities have their own background check process and may decline your clinical placement.

Im not saying this to tell you not to pursue your RN, but more as a warning and for you to be prepared. It would be prudent for you to contact your state BON and anonymously ask about this. It would be awful to get to the end and graduate to find you can't be licensed right away. That's a lot of time and money wasted.

I believe there was a post recently about someone in a similar situation. They had a suspended or probationary LPN license (I forget which) from a different state then the one they challenged NCLEX for. After passing NCLEX they were denied licensure based on the status of their LPN license. You can search it and see if they got good advice on what to do.
