Excerpt from June VB:

Demand for numbers, primarily by Citizenship and Immigration Services Offices for adjustment of status cases, is expected to bring the Employment Third preference category very close to the annual numerical limit in June. As a result, this category is likely to experience retrogressions or visa unavailability beginning in July. Such action would only be temporary, however, and a complete recovery of the cut-off dates would occur for October, the first month of the new fiscal year.

Starting the fiscal year of October 2007 only EB1 and EB2 have been current. Which AOS applications does this mean?

Nurses with BSNs and ADNs are all under EB3. EB2 and EB1 are those with at least Master's degree.

Was retrogression bigger last October? I mean how many years behind were cutoff dates, does anyone remember?

So it was much worse than the cut off dates are right now. They don't anticipate it to retrogress back as far, but you never know.

Well, they said "complete recovery of the cut-off dates would occur for October". I wonder if this means end of retrogression in October?

If someone could please shed some light here:

My pd date is October 06. I am in the us working, I-140 approved, I-485 request for further evidence requested back in October 07, case has been pending since. I now received another appointment for biometrics. Does this mean anything (good)? Why a second one when I already had one done in dec 06? Does it mean they are looking into my case? Thanks....

No. It means the best they can do after retrogressing the dates is bring it back to where it was before they retrogress it starting Oct. In essence, what the dates are before retrogressing the dates or making it unavailable will be more or less the dates will be come Oct.

This is of course, if they will really do this as they've noted. You'll never know if they'll have a diff. note in the next VB. Some immigration lawyers are still scratching their heads with that note saying that it is not legal to exhaust all visa numbers on just the 1st 3 qtrs since visa # allocations is suppose to be spread out on a per qtr basis.

i just want to ask you opinion about this.. I emailed NVC last May 1 and after 2 weeks they responded and told me that my case is currently under administrative processing. The NVC will send further instructions once this processing is completed.

any idea what administrative processing means?

thank you for your reply. i updated my ds230 and sent it to my agency but they said that they have to wait for my pd to be current before they send it to nvc..

Hi to all! I have a problem with regards to the DS230 of my husband who is a seaman & is on board the cargo ship right now. He sent me a DS230 form with just his signature and not filled up because of time constrained he just gave the form to the outgoing crew. My question is can I fill it up myself with of course my handwriting? I really pray you could help me . I dont know if what port they will be the next time they dock and it could be impossible to reach my husband if it is an inconvenient port. I am so anxious coz I know it could delay my papers to be reviewed by NVC , this will be the 3rd time I will submit our updated DS230 and he is included in the original DS230. My PD is August 2005.:bugeyes:

hi, edzz! i think you can fill it out yourself as long as all the information about your husband that you write down are correct and accurate. :-) but to be sure..you can ask you lawyer.

Many thanks Leis23, another thing do we have to submit a Police Clearance along with NBI? Coz previously I had submited NBI certificate only. Our coordinator here in Bacolod City told us that we have to submit both, but is Police Clearance necessary? Did you submit Police Clearance and NBI also? Thank you Godbless.
