I lost my job

Published

I need some advice. about 10 years ago I had my daughter at daycare and they lost her. I found her and the cops said I was neglecting my child and called CPS and they took my daughter for 3 days. they brought her back because they didn't have any evidence. I started working in a LTC facility a week ago and they called my this morning and said they had to let me go because of child abuse. I was never charged with anything. and now my heart is broken because they act like i'm going to abuse some little elderly person. I would never hurt anyone and have been crying all day because I know that I woulnd't hurt anyone. I don't know what to do. Will I ever be able to have a nursing job with this thing? It doesn't show up on my criminal back ground check, I've only had one ticket in my whole life and that is it. any advice as to how I can get this off of my record? any thing would be appreciated.

I am sorry that I don't have any additional advice, but I just wanted to say that I am really truly sorry for what you are going through right now. I wish I could tell you something that you don't already know, but you do need to get a lawyer. Good luck

Thank you! I am looking into the laws and trying to find someone through legal aid. I read that if the charges were unfounded they have to expunge them from your record in 6 years. Well this was 9 years ago. So something fishy is going on. I just don't understand that if they received this report on the 11th. then why did they let me work up until this last wednesday. I was so sad when they called, I was really getting attached to the residents. I don't think I ever cried so much in my life. It just really makes me mad that they would think that I would hurt anyone. I'm just not that way. I went into nursing to help people, not hurt them.:crying2:

That is incorrect information.

You cannot expunge an arrest or conviction that doesn't exist.

Simple, investigative records, are kept on file, and do not need to be expunged because they are not public information.

Expungements are only done by court order.

Again, I don't think they pulled up any record...I think that someone that doesn't like you gave them a phone call.

Oh my goodness, that's awful. It doesn't make any sense if the daycare lost your daughter and you weren't even arrested. I'd definitely be making some phone calls.

I agree that something is fishy. the problem with anyone calling, i don't know many people in this area and the ones I do know are my inlaws and they didn't know anything about it. I have a copy of the background check that they done on me being sent to me so I can see what the heck is going on. I looked up on the laws and it said that you are only disqualified if you are convicted of felony child abuse or neglect. I will be looking for a lawyer on monday. The only thing they did was investigate. Then they sent me a paper saying it was unfounded. I didn't know that they couldn't release that information if you weren't convicted. Good to know. Thanks guys you have been a huge help to me. :loveya:

YOU GOT IT!

It is only relevant to your background if you were CONVICTED of child abuse and neglect.

Think it through.

Let's say my next door neighbor called social services on me because she was mad about something and made a false charge that I was abusing my children.

They have no choice but to investigate.

If that were held against you, then it would be easy as pie to give a "black mark" to anyone you didn't like that had children.

That is why you have to be convicted in a court of law for it to be relevant. Investigations are confidential, by law, because they involve minor children.

well according to the cps worker i will never be able to work as a nurse. would have been nice if they would have told me that 4 years ago:cry:

What?! Why?

Didn't your school do a background check along with a seperate one checking for child abuse/neglect?

My school did one in the beginning, and then again during the 2nd year b/c of peds rotation it was required by the hosptial and children's home we were doing rotations at.

It doesn't make sense that you were clear during nursing school and now all of a sudden it's appearing on your record. You should do more digging and get to the bottom of this.

My heart goes out to you...this doesn't seem right at all.
