Hippa Law Pertains To ?????

I have a question.....its about HIPPA.OK.....I was injured at work .....had to have surgery.......my charge nurse (i understand) has informed people on my unit that I had surgery ....and that I am in a workers comp litigation to make the hospital care for all the injuries I received(apx 200 lb pt passed out slamming down on my spine).I take this as a blatant violation of my HIPPA law protection.Its an invasion of my privacy...its none of their bussiness.....its unethical and wrong...and illegal too isnt it?:o

Sounds like a blabber to me. Some people have a hard time controlling their mouths.

As for co-workers discussing you- only if they are stupid. I had a fellow nurse start to tell me about another co-workers supposed mental problems. Told her to STOP, that I in no way wanted to hear it. She apologized and quit talking about him. This type of thing is not worth losing your job over and I am surprised that your charge nurse would take such a risk. She has put herself in a very bad situation.

Been there done that got the TShirt. Management plays games with injured employees and I see it over and over again...the intimidation, the gossiping (Do you think she faked it?)Your employer does NOT have YOUR interests at heart here and it is important you recognize this. Even if your manager loves you she likely will be pressured into this game by HER supervisors.

The goal is to make you go away quietly. Find people you trust to treat you medically and help advise you through this. It isn't easy to go through this, and I hope you heal quickly with few residual problems. Think carefully through what you do, ask people you trust for advice, and resist acting without thinking of repercussions, when we are hurting we don't always make the best choices in the long run...take care! :kiss

I know everyone pretty much knows I am not faking it.....My shoulder is deformed now....and I have a titanium plate and 4 screws in my cervical vertabrae to prove it......but.......mattsmom81.....you hit the nail on the head of my worst fear.It is just embarrasing......none of their bussiness.....and a blatant violation of my hippa law protection.

I am glad to see you are turning this over to your attorney. This is what I would have advised.

It is illegal to discuss an employees personal and or medical issues with anyone. Infact very few people have a legal right to your medical records at work and your supervisor (In most cases)is not one of them.

She there fore has no right to discuss this either.

I am sure if the legal dept where you work got wind of what was going on she would be in very hot H2O. Just let your attorney handle this.

She is stupid. Whenever there is pending litigation about anything the last thing you should do is talk about it.

You poor thing! My heart goes out to you! Will you be able to work again?
