Have you ever been put in a situation in which you think your license could be in jeopardy?

I didn't mean to sound angry in my post, but I do feel like we have to stand up for ourselves. In my state(mo.), there are no peer assistance groups for recovering nurses. My agreement states that I cant carry narc keys(Fine), cant administer narcs(fine),cant work eve/nocs. I also cant utilize a pixus if there are narcs in them. I also submit drug screens, and have chemical addiction evals done every 4 months. During the majority of my using, I wasn't working and didn't divert meds. I feel like all the restrictions are preventing me from gaining employment. I am fine with not carrying narc keys. All of these restrictions are in place for 5 yrs. I am going to trry to approach the board first to see if they can lighten the restrictions or shorten the probation. If that fails, I dont see why I shouldnt get a lawyer. Thanks!!

As someone who was on probation for 31/2 yrs, with no alt. program, I understand!! I did not have the narc restriction, but I also did not seek jobs with narc access. If you live in a larger city, are there nursing jobs that do not involve such restrictions, like dialysis centers, Dr Offices, blood bank, UR, nursing home MDS, psych nursing, to name a few examples.

Back to the topic though, have you signed your agreement already? If so, I only suggested what I did because I have known personally ,and read about others,who petitioned for a change in their contracts , were refused, and also were treated much more worse after doing so. One was kicked out because her paperwork was late.

I would wait at least 3 yrs before asking for a reduction.This way you will have shown them you mean business, and are reliable and so forth. I have to ask . what are the 4 month drug evals alll about?? If you are an addict, that does not go away!!

DO NOT proceed ONE step further without an attorney! The cost is NOT as much as you would think. Most of the nurse attorneys will allow monthly payments. Most charge approx $2500 flat fee. I know what I am talking about! I am going to fight the BON in my state. They have TOOOOOOOOOOOOOO much power!

BTW I guess you have already signed the Agreed Order. If NOT, DON"T....please get an attorney STAT!

The order pretty much went down without much feedback from me. At the time I was @ the lowest and just decided to stick my head in the sand. Now that I actually have some spunk back in my spirit, I would like to have some restrictions lifted. I have applies for at least 10 jobs for which I am qualified and been rejected.Exnursie, my quaterly evals, are basically a thearpist eval. of me in my recovery. All this rejection really hurts, it just seems that this profession isn't very forgiving. I contacted an attorney today who used to work for the state board here in missouri. I thought a consultation wouldn't hurt.

There is a lot of truth to the old addage, " People Who Live In Glass Houses Slhould Not Throw Stones " the BON is totally outside of any Constitutional Law regarding Human Rights, due to it being an appointed agency of the State, with State powers and being unaffected by Federal Mandates of any type, I have been in contact with a Federal Attorney on a case for me involving Due Process Rights, I have been battleing this for over one year and still haven't found any remedy or been relicensed, this after 17yrs of Critical Care Supervisory Experience. I am in the process of fighting an Agreed Order myself. I have a nurse attorney where I found her name on the TANNA. The whole cost will be $2500. Will I win? The answer is probably no:(

My lawyer friend (whom I never discussed this isssue with until recently) was very disapointed with me for signing such an order! Never sign ANYTHING! Always get an attorney!

Im happy you are entertaining the thought of fighting this for my attorney informed me many, many nurses NEVER do which in turn has given the BONS across the country to feel very powerful. No entity needs the power they have.

Also, write your govenor and get his/her offfice involved for the governor is the person who appoints these witches to their position.

I see from the above posts that impaired nurses may only get a second chance IF they have a peer assistance program in their corner. Good luck to all of you. My nurse attorney was able to help me overcome a vindictive, untruthful reporting. If I'd gone it alone, I wonder what the outcome might have been, so I highly recommend RNJD's. :)

The attorneys group that I spoke with are not nurse-attorneys, it's a private firm. However they do a lot of cases like mine. In fact one of them used to work for the state board here in missouri. I thought I would go for the consultation and see what they could do, the cost, their sucess rate. Does your state have a peer assistance?

In the state of oklahoma, the PEER assistance department is supposedly a entity seperate from the BON, however, I found that all the PEER department administrative staff were former BON investigators or other administrative personnell of the BON formally, and the counselors in the PEER groups I had to attend were either on the BON or held some administrative position in the past in the BON, also the things that I stated in the groups believe it or not made it back to the PEER committee and the nurse handling my case, this is a very unfair, unbridled, fear no consequences for mismanagement or deviant behavior, department, such as th BON, best thing to do is to really do an exstensive background check of every state you are going to or are practiceing in and the actions that their respective BON' have taken, along awith the outcomes. Always proceed with the assistance of an RNJC. Good Luck. 's with wolves.

I AM A NEW NURSE WHO'S LICENSE IS ABOUT TO BE UNDER A NARC RESTRICTIONS, BUT HAVE NEVER TAKEN ANY NARCS FROM ANY CART. i TESTED POSITIVE FOR A DRUG SREEN IN 06' AFTER EXPERIMENTING WITH A STREET DRUG(TOTALLY OUT OF CHARACTER FOR ME). I AM AFRAID THAT THE JOB I AM AT NOW WILL GIVE ME THE AXE:o AFTER MY AGREEMENT WITH THE BON BECOMES FINAL. DOES ANYONE KNOW WHAT I CAN DO TO GIVE ME A CHANCE AT KEEPING MY POSITION AND STILL FOLLOW THE BON'S REQUIREMENTS?
