H1b Visa for nurses under FY 2010

I have applied for a work visa for the position as a dialysis nurse. I was filed last april 1 2009 and was wondering when will i get to have a visa? Anyone with a similar status of mine???:specs:

No they are under SGS Human resources before. I hope they will hire again. Are they only hiring Male Nurses? Before they wanted the first batch to go there under a student visa for fast deployment with $960 allowance i think...free accommodation and depends on your performance if they will hire you.

Did you accept the job? I think it is a good opportunity while waiting for your priority date to be current.At least you get to practice in a U.S. Territory.

NOT A GOOD IDEA!!!!!!. Never agree to come here without a valid job offer. I heared some nurses from the Philippines who are NCLEX passers and came here on a student visa before( under old immigration) and they ended up working part time in a farm. They didnt have a choice but to go home eventually. You cant survive here without a job. No available part time job either. Work here is scarce. BEWARE:idea:

St. Jude Renal Facility is "hiring" volunteers right now. It is a combination of the surpulus of nurses and also the law of the Northern Mariana Islands. Saipan has 3 nursing schools which graduated 60 nurses in the past year with only 12 new openings at the Saipan CHC hospital. Additionally there was a law which didn't allow foreign graduates to work at private clinics unless they had 2 years experience (now applies to the CHC hospital as of 1-1-10).

I personally know of two r.n. nclex passers that actually did "work" at St. Judes and one was directly hired at St. Jude's for $8/hr (last 2 job openings 8-10-09 at $7-$9/hr posted on CNMI DOL website), the other was hired for the Tinian Health Center, but he had problems with processing his work permit, and he is now processing for a local clinic at $8/hr.

Due to federalization, since Nov. 28th Saipan is exactly like the mainland U.S. for immigration, tourist, and student visa purposes. There is supposed to be a CW Transitional Worker Visa that should allow new r.n.'s, cna's, and lpn's to be hired from off island, but as of today the regulations are still not out yet.

Saipan currently does allow unlimited caps for H visas for nurses, but since the CHC hospital nurses all have 2 year contracts, they will not begin to process any H visas until March of 2011. And the private clinics can still "hire" volunteers, so as of now, I don't expect any H visas anytime soon.

Oh my goodness!!! is this really true..? thanks guys for telling this to me before i put myself into a process that could put me into a big jeopardy.. Anyway.. I'll make it sure to the agency if they are going to do it in a legal process.. if it does, i will push through.. and if what you've said is, i guess I better warn my colleagues who also had their interviews.. thanks guys!! now I'm confused... :uhoh3:

I don't know how an agency can get you into Saipan right now. Since Nov. 28th, you must go to the U.S. embassy in Manila for a tourist or student visa, and the student visa requirements are the same as any university in the U.S.

That being said, if you have the opportunity to come to Saipan, it might be a good choice in the long run. As NurseDandy stated, some nurses have come to Saipan without jobs and ended up working as farmers or maids to make ends meets, but their are others who volunteered and worked at local outreach clinics such as breast cancer, women's health, vaccination campaigns, and ofw, gained experience and some are now working at the CHC hospital making $16+/hr.

If you are in the Philippines volunteering at a hospital, or worse paying to volunteer at a hospital, it might be a good choice to come to Saipan, even for a low salary. You can gain experience and advance into a better paying position. I expect within the next month or so, there should be regulations on the CW transitional worker visa, and nurses will be hired from off-island, but I wouldn't expect high salaries from the begining.

As a new grad you really do not meet H1b criteria of being specialised and just being hired at the dialysis center would not make you a specialist.

unless the facility is a non profit making establishment and not capped then filing is done in April and you can not start work until Oct if successful in obtaining a H1b visa and that means if your OPT has expired you will have to either leave the US and wait for your interview or maintain a student status

I would actually agree with Silverdragon, you probably don't qualify for a H visa based on merely working as a dialysis nurse. You would need to be in an administrative position, have a certification such as in nephrology, or work in a hospital that only hires BSN's for that position, plus no USC or LPR are available.

Fresenius Medical Care North Amarica ruined my life. For one year of working on them, i was given a irresponsible lawyer. I was given a work authorization but failed to ahave an approval in I-140. Including my family's dream was ruined. I was force to fly back to my coutry. Yes, before i go home their paying me 28/hr. I was in the Acute. My lawyer failed to submit the additional evidence that the USCIS is asking on time. LATE submission. So much....

I actually don't think the lawyer was to blame. In 2008 only 136 H1B visa for nurses were approved nationwide. An additional 100+ were processed throuch h1c. It is possible by it will extremely difficult. A few years ago there was $5,000 to $10,000 sign on bonuses for nurses everywhere in the U.S. I haven't seen any recently. I would suggest trying a nationwide search and if there a is hospital or nursing facility willing to offer a sign on bonus, contact them to see if the are interested in a sponsorship.

You do not apply for a H1b your employer has to. As a new grad unless you are specialised in your experience may find it very hard to find a employer willing to file a H1b especially as they have to prove that they can not employ a USC or PR first and with many USC and PR looking for work will be hard.

You also need several years experience in a specialized field, not necessarily in nursing either BA is the minimum requirement. Read up on the requirements for H1b visa, it's posted all over this thread, and most likely you don't qualify for it. You may need to research other options and prepare to wait years before getting a visa. Good Luck

Guys i got an RFE. The lawyer are responding to it before March26. We're also asking from an expert opinion to defend the argument that USCIS laid on us. Every immigration attorneys do it so i have no question on that. I hope everything went well on my status.
