H1b Visa for nurses under FY 2010

I have applied for a work visa for the position as a dialysis nurse. I was filed last april 1 2009 and was wondering when will i get to have a visa? Anyone with a similar status of mine???:specs:

Be aware there is usually a time frame to activate the visa, may be wrong but 6 months comes to mind and you have been waiting 5 months. When H1b is issued it is usually because you have a job to go to and if still waiting indicates that the visa was given when really no job and could be seen as fraud

I would contact them and also do a bit more research on H1b and activating it

Why did you guys eligible to apply for it , even you only got a dialysis nurse position. As I know, it is not necessary to have a BSN to take up such position. right? You can not apply for H1b your employer has to. BSN is minimum requirement and all have now gone for this year so unless the hospital is not capped then your employer will not be able to file until April 2010 and start work Oct 2010

I am working in a homecare agency. My boss is willing to sponsor me to get the H1B visa. However, I am not sure I am eligible to apply for the visa. It is because my lawyer told me that the position of visiting nurse is not required for BSN. So anyone can tell me whether I can apply for the H1B visa or not. Thanks.

Do you have a BSN? If working homecare agency what visa are you on now? I doubt that it is uncapped therefore your employer needs to prove that they can not employ a US or PR and they can not file until April 2010 and you can't start working until Oct 2010 if you are successful in obtaining a H1b

Wait you're working at a homecare agency and your boss is willing to sponsor you to get the H1b visa? Are you in the US working at a homecare agency? Or are you working overseas at a homecare agency? If that employer who is overseas is willing to sponsor you for a H1b visa, then that wont work. The potential employer has to be in the US. Most nurisng positions DON'T require a BSN, unless it's a specialty and you still need seveal years experience in that specialty. The company also has to prove that they can't hire a qualified US Resident/citizen to fill the position.

Just an FYI, people on the H1b visas are being investigated because there has been people abusing that visa. So to those, they will most likely get deported and banned from returning for a very long time. You do the crime, you must do the time.

Doesn't matter your employer still has to prove that a US or PR can not do the role. Even if your employer files in April 2010 you can not work after your OPT is completed as you can not start working until Oct 2010 and you have received visa. So you will have to maintain a legal status from June 2010 until you start work. Just because your employer filed for H1b doesn't mean you will get one, the consular can still deny you it as you will have to attend a interview. Also will need VSC

You don't qualify for a H1b visa because you're a new graduate with zero experience in a specialized field. We have many new grad RN's who can't find a job in the US at this time, so there really is no need to import. You will have to look at other options if you want to stay in the US, most likely you will have to return home and apply for a immigrant visa and wait sevearl years in order to have a chance at a visa. Too many visa applicants and not enough visas.

Actually speaking Chinese isn't a good enough reason for a H1b visa as an employer CAN'T require that Chinese be spoken for a job. They can state in a job announcement that "Fluent in English/Chinese preferred" but never required.

Thank you all of your reply. Anyway, if I can't apply the H1B visa , I will continue my study in ANP. For my curiosity, if I get my ANP certificate later on, do I need the VSC too?
