Fired for emergency room visit

My dad is a nurse on long island. He became a nurse about 5 years ago after he got his associates degree from a community college. It is also important to know that my father suffers from bipolar disorder, and 10 years ago when my parents divorced he went into a deep depression and was drinking. to make a long story short my father ended up with 3 felony (class e) DWIs 10 years ago. As far as we know NY has no expongement so there is no way to get them off. He did a rehab program (10 years ago) and does not drink and went to nursing school to change his life and build a carreer that meant something to him. Now because of his record he must take the most stressful jobs despite the fact that he has good experience. He gets the leftovers, because once he tells a hospital or facility about his record (which he is incredibly embarrassed and ashamed of) they turn him away. Now in addition to this, at his last job in bellhaven hospital on long island, he was a supervisor nurse for the evening shift. Often if the overnight charge nurse went on his shift they would make him take a floor even though it was his shift to be charge... anyway, one night my father became very sick at work. He had been put on a new medication (depakote) and was reacting very badly (work did not know about his bipolar) He started sweating and his blood pressure went sky high despite his blood pressure medication, and he described that he had right flank pain that was at a 10. He called his supervisor and told her what was going on and that it was an emergency, he said his eyes were getting blurry and that he was in excruciating pain. His supervisor told him that she wouldn't come in and that he had to find someone, he reiterated his pain (to no avail).. so then he tried calling a few people. No one answered or would come in. My dad started feeling worse and he looked so bad one of the CNAs said that they would drive him to the hospital, my father was worried bcecause there was no other RNs on but him in the facility, but there was nothing more he could do and his blood pressure went even higher and he was keeling in pain... he went to the hospital with the CNA. They told him he had passed a kidney stone and possibly had a reaction to his new med. Then when he went back to work he was fired. Then my dad fought for unemployment stating he had been fired unjustly, NY state did an investigation and determined this was true. Then he started receiving unemployment, and then they took him to court to get back the unemployment. there were two witnesses, one told the truth and one lied. in the end they said my father had to pay back 8000 in unemployment that he had received. He is devastated, one because he truly felt he had no where else to turn that night, and he couldn't think straight, two because he feels like a failure as a nurse and in life (getting VERY depressed , and suicidal urges), three he worked so hard to get out of the whole he was in only to now owe all this money and be unemployed (and getting more and more depressed since he is 56 with no retirement saved, no house, few family members, lives alone), and finally he is so daunted to get another job because he is scared that maybe he just can't handle it and that he is a failure, and he is worried since he can only get the jobs that no one else wants because of his reccord. Does anyone have any advice, especially about any possibility of expongement in NY.... He is a very good nurse, and he cares more about patients than most other nurses I see, he is truly caring and wants to make their quality of life the best it can be for however long they have to be in care.... help! he really is hardworking and a good man... he's just not perfect, but he doesn't deserve this....

First of all, I am really sorry that your dad is going through this. However, from your post, your dad abandoned his position--a big no-no in the nursing profession. Now I totally understand why he did as he did. However, I do also sort of see the employers point of view. I think the person who is responsible for all of this is his supervisor. She most definitely should have come in for him. Again, I am really sorry he is going through this. Nursing not only eat their young, they (nurse managers) eat anyone whom they can.

This is a very sad situation, while you purse all the legal options that have been suggested, I would like you to explore spiritual options also. He needs to find people to uphold him, believers who will pray with/for him. I pray the good Lord will heal his mind and body, restore all he has lost and grant him peace.

Dear BC,Tell your dad not to lose heart he has a great daughter.Being bipolar myself and having been in a bad situation I can sumpathize with him.I worked for 30 years at a large hospital in administration,critical care and was even nurse of the year.We had a pt transferred to our ricu from micu after an arrest at home with brain damage from anoxic encephelopathy .Found unresponsive,adm.cpr by her father( a pompous old doc not from our hosp).The nurse from icu said "This is the absolutely worse family we have ever had to deal with.I am so sorry"The family harassed the Drs and nurses and were in the room constantly unless the were outside the area calling each other.They had no idea what was going on.The sister was 58 years old but hadn't worked in 20 years and had only worked in an office.The patient was spastic,nearly fell over the rails,pulled out her ivs constantly,they didnt want her sedated,or restrained .The Drs said the family is not dictating care.The morning I had her she was so agitated it took 3 nurses and a dr to keep her in bed,she was pulling at her foley .Her attending said sedate her and I said,I think we should take the foley out.When I deflated the balloon all this blood and purulent material came out so I told the resident to order a culture of the tip and a urine c+s(already sent) and then he was called for a code.We got her settled ,physical therapy came in.I checked her feeding tube. She had too much residual so the doc said shut them off for now.Her ivs were running and she was stable.My other patient was a little post mi in and out of confusion that would only stay in the chair.Her doc came in and said you have the best nurse in the hospital,she didnt want a posey on,so he ordered no restraints.I said shes going to get up and fall."No she won't" he said.My other patient was an unstable cardiac patient who ended up with me in there for 2 hours titrating her nitro drip up to 200 mics and giving her mso4 iv and trying to keep her bp up along with managing her other drips and soothing her family and her(she was an rn).So after 2 1/2 hours of being in with her and having rns checking on my other patients,spaz pts husband calls me in to tell me sister wants to talk to my head nurse on the phone.I went back to the office,my hn response was" if I talk to her Ill never get this paperwork done in time to go on vacation.I had to go back 3 times.She said can't you handle it'?NO they want to talk to you.Meanwhile spaz pt had slid down in the chair,I couldn't find anyone to help get her up in the 3 min alotted time the family allowed.At 6:30 I had 3 techs in front of me.Little old lady got out of the chair and fell,spastic woman pulled out her Iv for the 3rd time,and Mi was having chest pain.Well chestpain came first,I was in there for an hour,another rn checked on the other 2 for me,There was still too much residual to start a feeding,iv was out and no foley when father came in.I was in the doorway watching head trauma lady and waiting for the page to come back when pop Dr came screaming out in the hall WHO HAS MY DAUGHTER!!The charge nurse said I did.He yelled down the hall She has NO CATHETER OR IV and SHE HAS NO FEEDINGS ALL DAY!I said I cant leave I did nt even get to finish .I SAID HER SKIN TURGOR IS GOOD

I don't know what to tell you, but I'm very sorry that this has happened to your father. He doesn't deserve this kind of treatment.

My husband is going through something like this as we speak. He was diagnosed with Bi Polar disorder 2 years ago. He had been working at the Post Office and when he cycled (prior to medications) he would call in sick and not go back for weeks or months. They fired him for it after two years of it. The union fought for him to get his job back and he won. So last October, he returned to work. In December he had pneumonia with Chest films to prove it... and in March he had an ear infection that had him at the doc twice and on the couch with a heating pad for 5 days (2 of which were his scheduled days off).... a month after the fact they decided to fire him for those absences.

He applied for unemployment and the Post Office denied it. We appealed and he won the appeal.... so he has been drawing unemployment for about a month and 3 days ago we get a letter that the Post Office is appealing the appeal. There is a hearing scheduled for the 15th and we might have to pay back unemployment as well.

I feel your pain. My husband is a good man who was just feeling like he was getting his life back together and was blindsided by this. All I can say is take heart, things will work themselves out in the end... and PLEASE advise him to get a lawyer!! This is the position we will be taking if he loses this appeal as well.

I'm so sorry this happened to you. It seems that this is often the case when things get in a bind no one wants to take the heat, so they find one person and blame them completely. The supervisor at my dads job also had told the court that the main reason he was terminated was because he refused to take a floor (instead of be supervisor). He never did this. He said he would never refuse an order from a superior. So they just made something up. Just to get him. I think if you have a talent in writing you def should write a book. I actually saw another one.. I forgot the name of it but it is blue and it has a nurse on the front covering her faace sitting on a bench... its about basically all the polictical and organizational problems with nursing that cause it to be a leagallly scary place to be, and a place where job security is non-existant. Don't be afraid to re-enter. My father was too. I convinced him he needed a change, so he has moved to boston to start anew. If he has problems and needs to go on disability the state has free healthcare and because it is so liberal, there are allot of programs at his disposal. Also he has decided to go into fee for service home care with the visiting nurses association of boston. This way he doesn't need to interact with a staff that could turn on him at anytime. I think this is the best route for him considering the level of his anxiety, and the confusion he experiences with this anxiety or stress. I think he is a great nurse, but I feel much safer (for his sake) if he stays in home care. I think he enjoys this more as well. Maybe you should look into it. Its better than giving up. Where are you living?

Dear Danielle, Darlin,I am not giving up.No ,there are too many battles to fight.I cannot nurse anymore ,not just from my bipolar 1 disease or bippy as I fondly refer to it.(as in kiss my bippy).I have csf/fibromyalgia from what we believe was a bout with the coxsackie(?) virus in 1993.I had come home from a trip to England and I broke out in a rash all over my body.It turned out to be pit.roseacea.About 6 mos later I started with fatique,temps,hot spots etc.but I worked for 10 years with it(sometimes with spandex and splints) but now I have 14 hot spots.So im poor,in pain but I am not complaining.There is always someone worse off than me.I have a mother who goes to the DR if she farts too hard so needless to say she is a constant source of amusement.Sorry for the spelling I've been up all night wrestling with some nasty computer variants that crosses firewalls and virus programs.Its called the vx2 and lavasoft is the only company that has really addressed it .You don't even know its on your machine until it you get automatically redirected to a page.I was signed on by aol fast start,thats how I knew.It is one of the worst and I have all the patches and security stuff you can have.Check it out.Good day to all my wonderful nurses.Love you all.Im proud of you.
