I am 99% sure that is pure myth for a couple of reasons.
#1 The $500 fine is suspiciously similar to the $500 fine in Singapore for chewing gum.
#2 I have never heard of nor can find an example online of an individual being fined. What could be confused for an individual being fined is that OSHA can fine the company for each employee not in compliance.
#3 OSHA was designed to protect employees from hazardous working conditions set by the employer, not to punish employees.

It has to be an urban myth. The Occupational Safety and Health Administration's mission would not have chewing gum as an employee under their domain. Please check out their mission statement at http://www.osha.gov/oshinfo/mission.html.
