Hi, when I was 25, 9 yrs ago, i gat a felony g/theft charge. Since then I went to school for CNA, and applied for an exemption through the BON.(it was granted for CNA RN LPN). Since then I just got accepted into the RN program at FSCJ in Florida. We were told that if Baptist Hospital dont except us for clinical training, we have to withdraw. I gave a copy of the disposition and exemption from BON, does anyone in this area knw if they have ever denied student clinical access at this hospital in Jax. fl. It will be so upsetting to get this far, and have to withdraw and reapply at other schools. I thought once I got the exemption I would be fine, but I just dont know.

This will help you determine whether or not you will have issues with the BON... remember, this is recent so you may have to "re-apply" for an exemption. (CH 409 is public assistance crimes, 817 - fraud, 970 - drug related).
That being said, I just finished FSCJ (Yeah!!!). I don't have a felony so I don't know whether Baptist will or not. I have 2 misdemeanors and Baptist never batted an eye. (Mine were "Theft by check" charges.)

How did things turn out for you? I am in a similar situation. Grand Theft 7 years ago,have my CNA and begin nursing School in January.
Long atory short I was pulled out of class the 2 week, so depressing, so Im got my record expunged like a previous student, it worked for her , hopefully it will work for me.
Keep moving! I was hired at a local hospital, have no problems with clinicals and will have a job when I graduate. Try and get around doing clinicals at sights that have a problem with the background. Better yet, go and speak with them personally. If you did get it expunged then you wont have any problems as all.

Let's all realize that the new regulation is for a Felony after July 2009. A law cannot be retroactive, this would be like lowering the speed limit on a road then sending out speeding tickets. There must be a start date. The questions are askon the application and if the question applies to you then you must explain and include the date.
Please reread the law..it is for a Felony after July 2009.

I have a felony record from30 years ago (1980) of which I'm dealing with now. I have been working as a nurse for23 years, had no problems in the past, decided to apply for an ADON position, and was told they could not hire me because my record made me in eligible. I'm 54 years old, what else am I gonna do? I live in Florida, and I'm applying for exemption through the board of nursing. Pray for me!

This is not legal advice- this is information available to the public: Check the federal OIG (hhs.gov is a starting point) site for exclusions, to see if your name is on it, or if your crime prevents you from working in certain health care areas that receive federal funding. Also, check your state'e barrier crime laws (search :FL barrier crime), to see if your crime is listed. But if you have been working as a nurse post-felony for 23 years, it sounds as though the company you applied to has a no felony policy, not that you are legally prevented from working in that place. So they should have told you 'won't', rather than 'can't'? BTW- if anyone with a record wants to go to nursing school, this is a also good idea to give you some information about whether you may or may not ultimately obtain a nursing license...
