Wouldn't the FDA be, at least, partially liable for the damages incurred? Can't see them being protected by sovereign immunity principles if they had an obligation to monitor, did so, discovered a problem, and then did nothing about it.
Let's see how this goes.
Another conundrum: imported scallions? Thought we had many sources of these in this Commonwealth... many local farms here in the Berks / Lancaster areas.
Im not sure if we have a chichi's down here. But they're filing for bankruptcy (they say it was before the incidents). I wonder why they can't find out where the green onions came from? When I worked at headstart our vendors always gave us the source of any fresh produce. Or I wonder if these were "under the table transactions?"

Well I have been posting a lot of links here about that big hepatitis outbreak. It is starting to look like this is the third or fourth outbreak caused by the same produce, namely imported scallions from south of the border or southern Calif. It is also looking like the FDA has known for sometime of that connection between the imported scallions and hepatitis but never did anything about it.
