Expunged Wet Reckless

hello,

I have been accepted into a ADN program in California and was told we need to clear a background check required by clinical facilities. I have a DUI from 6 years ago that was reduced to wet reckless and later expunged. but we were told we need to disclose any dismissed or expunged records with an explanation letter for school to submit to clinical sites.

has anyone here have had similar situation? If you have any negative feedbacks please keep it to yourself I am asking for feedback from those have been in similar situation.

Tough one. Part of expungement is that it lets you not have to disclose such information in most cases, so you can answer "No" to those criminal history questions...

But here you are being asked specifically about this information. And you definitely don't want to have to deal with a school or clinical site that finds out after the fact that you didn't disclose something you should have.

As we can't offer legal advice here, you should contact a lawyer if you are at all unsure about whether to disclose expunged charges.

I will tell you that down the road, you will have to tell the CA BRN about the expunged charges when you apply for licensure.

This information is not specific to your situation, but it's something to keep in mind:

Not all background checks are created alike. The routine AHCA background checks are a day at the beach unless you are a blatant criminal cutting a swath of destruction across the US, with no regard for consequences. They abide by the rules, don't result in people being penalized for charges that have truly put to rest. The information may show up in healthcare facilities, child care, etc... But it's been my experience that employers who use the AHCA background checks aren't looking to exclude.

Now we move on to the 3rd party background checks. These can connect the client to BON notes, doctor shopping reports and God knows what else. Some are more comprehensive, some less. It just depends on the company. Hospitals use the 3rd party background checks because they are looking to exclude, not include. I had one hospital exclude me using one 3rd party background agency and another accept me using a different 3rd party background agency. Have you thought about just apply somewhere you don't really want to work to get a copy of yours? You're allowed a copy if you are precluded from employment. You may even be able to run a background check on yourself, I can't remember.

You need to know what you are dealing with, best way to do that is to find out what is showing up.

Very odd because clinical sites typically do not deny a rotation to students in a nursing program that has an agreement with the facility. The program does the vetting, not the clinical site.
