Hi! I hope I'm putting this in the right place, but I've been wondering if anyone else has dealt with this. I'm trying to apply for RN by exam, and I had to consent to the Adam Walsh background check. More than 10 years ago DCF got involved with my family because my (now) ex-husband assaulted  my infant, apparently a couple times. It was completely unknown to me, as I was at work when it happened, but she appeared sick, so I was bringing her to her pediatrician and the ER several times; it was only after my ex said she fell off the bed, that the ER finally did a CT, and found subdural hematomas. Very obviously, DCF got involved, initially took custody (I got custody back at the 72 hour hearing, after my ex confessed and I filed for separation). Because it took so long for him to confess, DCF treated us both as perpetrators and supported the Care and Protection. He was ultimately  charged and convicted of his crimes, and my child is doing really great these days with no residuals (thank god!!!). 

Any way... apparently my name came up on the DCF registry as being part of a protective services case, and now my application for licensure by exam is under review. With Good Moral Character, there is a list of items that the Board wants, but there is absolutely no information for individuals who show up on the Registry but have no criminal history. Does anyone know how long the review will take, or what they might want for documentation? I'm trying to pace myself studying for the NCLEX, and wonder if they will even let me? (I assume I'm listed as "neglectful" for "failing to keep the child safe", which I already feel sooo much guilt for, even though I was at work when it happened.) As additional info, I do currently work with children, and my history has never been a problem...

I hired a lawyer because they do this  every day and right now the board is so backed up. They sent me an email and told me it could be weeks just to get an investigator assigned. Lawyer said no way - that is not acceptable and that it should be days. So, I hired him. He said something about just going to court and getting it taken care of quickly. So, it is not cheap, but it will be worth it to me. I am on good terms with CPS and will forever be grateful for their help.

Sure. I don't know how to PM on here. This is all new to me. I am feeling confident that this is just a delay. It is humiliating to have to do this. My story is exactly what is on the CPS paperwork, yet I will have to tell it again. I wish they could just look at the CPS case and in home therapy and that I did not have to repeat it. 

I'm curious what kind of lawyer you hired? I went round and round and even contacted some, but could never quite figure out what kind of attorney I would need. 

They started doing this background check in Nov 2020.. because that's clearly the time to slow down the adding of nurses to the workforce, during a pandemic. Smh

Yeah it sucks you have to repeat it but honestly, im very surprised what you wrote in your post is exactly what was put in the report. Social workers have a habit of exaggerating the truth on their reports to justify opening a case and unfortunately they add people to the child abuse index after a case closes for funding purposes. Im not lying, it says for funding purposes on the literature. I can send it but I don't know how. Anyways... Writing a letter in your own words allows you to give your side of the story. Also, the cps report itself only lists classes you were "ordered" to take, it doesnt show what you completed, thats why you will have to submit your copies. 

Also, is the board investigating a past cps case or are the investigating why you were placed on the child abuse central index? You would know if your substantiated findings landed your name on the index because you would have received a letter in the mail stating that you were listed and you only have 30 days to challenge it.after that it gets harder to be removed 

I only just found out one day ago. They are assigning an investigator. 

I will be writing my letter and giving it to my lawyer. 

I hired a nursing lic atty in Boston. All they do is deal with BORN. I did Not receive any mail all I received was one email from a paralegal stating that I will be assigned an investigator "maybe within a few weeks". The attorney said that is not acceptable and I hired him because I don't think it's acceptable either. I need to be able to work. My case was opened when my marriage was ending and things were very difficult and my 15 year old child refused to come home from school. The police were called to the scene I yelled at my ex-husband to get off of your phone with his mother. That is why CPS was called, because I yelled at my ex-husband to get off of the phone with his mother. I divorced the abusive ex-husband, CPS pushed the therapy that I was already on a waiting list for (put on list by me), into place. We finally got the much needed therapy I had been waiting months for and then the case was closed. That was years ago. 

 The only thing an attorney is going to do for me is probably speed things up and they do all of the paperwork and that type of thing. To me it's worth it, because I am just at the very beginning of this, so to have it resolved quickly so I can continue forward would be worth it for me. He did mention going to court and just resolving it very quickly, and that is some thing I would be willing to do, so that I can move forward and put this behind me forever. 

Hi, I submitted my Application back on 25 May and just found out that I was flagged due to a 16 year old CPS case ? I've spoke with PCS, the Secretary for the BON, and DCF. They all basically told me that they don't have enough investigators to handle the amount of cases that have been flagged ? Ridiculous! Oh & the Board also only meets one time a month so there's that too!! I feel so helpless & frustrated ? 

That is the exact reason I have hired a lawyer. I can't wait months to years for this to be resolved.. I need to work. They added livescan  a few months ago - in the middle of a pandemic, and yet they don't have the help to deal with it in timely manner. 

Please keep us updated on your progress with your lawyer as I'm debating whether to hire one as well! Good luck!
