BoN report to police?

I'm currently under investigation for doing iv pain meds at home. I obtained these from an acquaintance. It was a one time thing and obviously a terrible choice. I am working with the BoN - I have confessed to them, am cooperating, am getting a drug/alcohol assessment, etc. However, I don't know if this is something that the BoN reports to the police? Does anyone know? Or do they simply do their own investigation/ punishment?

It's difficult to say because every BON is different but I believe when folks get reported to the police, it's usually by their work place for theft of drugs. That wouldn't apply to your situation. You could just ask your investigator. Frame it like "I need to know whether you will file a police report because I need to know whether to hire a lawyer." Or consult a lawyer if you have the money. They would also be able to help you navigate whatever the BON throws at you which probably won't be pretty.

I'd wait it out, as frustrating as that might be. In my state theft of drugs is a felony (probably every state really) and possession is also a felony (and yes, admission as well as positive UAs does prove possession). A felony can be charged up to five years after the offense has taken place. So really, they have two years left if try wanted to charge me. I have chosen to do my board contract and wait it out, if I get charged I'll deal with that then.

Know that admissions to one entity can be released to any other. So it is 100% possible that the BON could relay your confession to local law enforcement. If the BON felt that your use of IV medication at home rose to the level of criminal activity, they will likely report you and your statement will be admitted as evidence against you. However, if your state's BON has a diversion program and you have entered diversion, then all admissions via diversion should be protected by confidentiality privledge and should not be disclosed. Gonna keep short and on point to the best of my own experience. If police involved and there's a charge, it finds its way to your respective BON.

If BON because you sought them out most likely internal within the BON. Again, my experience...my hospital grilled my about X scenario. I folded and told them I had a problem. They asked me to resign in the condition provided proof I turned myself into to the BON, then they will not press any charges. I complied. I turned myself in to my BON. So, initially I was a self-referred member which I became board-referred after my BON investigated my own words given to the BON.

There was enough evidence to make me board-referred as oppose to self-referred.

Now, the wonder, which by the way I don't give a hoot about, did the BON try to send my case to police and that my hospital said NO, no need because we are content that RN turned self in. OR, did BON not have any intention to turn into police because they are handling things internally.

This is almost ten years ago, but I feel the BON, depending of course, keeps it confidential. Good luck to you RN1992PKWZ
