Being put Oncall too often

Hi, due to low census recently, I have been put on call quite frequently. I only work three 12 hours shift a week and can be put on call for two shifts. It is really hurting me financially but don't know what to do about it. Is this legal? Am I elligible for unemployment? I am from California.

If you are working in a union hospital, check your contract. Most contracts have a provision that states being placed on call must be done in rotation. Most hospitals also pay a percentage of your salary for being on call. If your hospital is not union somewhere in the policies & procedures there should be some mention of how call off are done.

My case is different.I applied full time in the place where Im working at this present time.Then they change my status to part time without even informing me.They told that if we cant complete our 6 days evrey 2 weeks then they change the status to part time.How can I even complete my days if they're cancelling me.I even put some days as available.They put priority on the nurses that are newly hired..And the cancellation is not done by rotation.Right now,they're orrienting a new grad nurse that will be working at night.The same shift were I work.Any advice?.. Btw,One of my co worker who is an LVN told me that she is full time but she only worked for 3 days in a pay period.ME,I only worked 2 days.

hi, it seems like you are in a worst situation than myself. I have been talking to quite a few friends from other hospitals but most of them told me that their hospitals are very busy and normally dont put nurses oncall unless it is an extra day. I guess it depends on the hospital that we work in...

I work in California and we get canceled on my unit when the census is low too...I remember a couple of months ago somebody did post a message from EDD (that's who handles unemployment, as you may know) about filing claims because your employer calls you off for 'slow business'. I wish I copied it because, of course, now it's gone. I tried scouring the EDD website but couldn't find the specifics. I would contact your union rep about this for sure. I am planning on it!

You can apply for unemployment if you are working less than full time. You would establish a claim, then report the shifts that you do work and would be paid your benefit for the days you do not work.
