Okay so here goes. I had a record expunge so long ago, and I never once had a problem obtaining work as an LPN but friday I had an interview with Armor Correctional Healthcare for a correctional facility in VA and was told I had the job as long as my drug screen is clean and my fingerprint background check comes clean. Here is the problem I have never had my fingerprint taken while applying for a job and so now I am worried that my expunged record will show and I will not get the job. My question to you is.... 1. Do you know anyone who has applied and obtain a job as an LPN with Armor Correctional Healthcare with a record expunged? 2. If so, did the record show up?
FYI: On the application the question was:
Have you ever been convicted of Domestic Violence?
Have you ever been convicted of a Felony?
Have you ever been convicted of a misdemeanor or traffic violation?
*Have you ever had any association / affiliation with a gang or gang member?
*Do you have any tattoos, marks, or scars on your body that could be interpreted (or mistaken) as being
gang related?
*Do you have any friends and / or relatives who were / are incarcerated or under the supervision of
Community Corrections or Probation & Parole in the state of Virginia or elsewhere?
****Nothing that would make me think I would need to disclose my record that was expunged****

Hi,
First, I hope that isn't your true name you are using. If so, please change it right away for your sake.
Second, I have never applied or know anything about that specific employer. I can only told what I know or have "heard" from others.
Often on an application they will tell you if you don't need to disclose expunged convictions. If you have questions the best thing is to contact the HR and ask if you need to disclose it. (This was advice from one attorney.)
Now, the best way to know if something comes up on an FBI check/fingerprint check is to do your own check on yourself and see for yourself. Do an FBI check and a state check (whatver that may be).
I know you are anxious and I wish I could offer you some comfort. Unfortunately you will have to wait and see what happens. A good friend once told me not to borrow trouble. (I am good at doing that.) Don't get upset until you have a reason to be upset.
I hope there is someone else out there who can really help you but I doubt it will happen. Regardless, if you don't get the job there will be something else out there. I think if you have never had trouble as a LVN you will probably not as a nurse.
The one thing that I was advised by some attorneys (they don't always share the same opinions) is that it is okay to say "no" on a standard BG check but if they run fingerprints you should say Yes and "dismissed" or whatever it is in your state. If you know that it doesn't come up under prints that is another thing.

I reread your post carefully. Who hasn't had a traffic violation? Wow, I will never apply there. Unless, they just want you to disclose your record as an honesty test. Traffic records stay around almost indefinitely.

I do believe they want to know even about traffic tickets as an honesty test. I do know of a sterling character who missed an opportunity because he remembered 2 previous traffic tickets, and forgot about the third.
I always believed an expungement meant that the record no longer existed. I could be wrong about that. I would definitely check with the state where the expungement occurred and the state where you are planning to work. (Expungement may not be an actual word because it keeps getting flagged by spellcheck.) In any case, good luck and hope this opportunity pans out for you.

The meaning of "expungement" can vary from state to state. You are correct that a "true" expungement would delete all the records. Many state licensing boards, for example, still want you to let them know about expunged records. There may be another way for them to "see" the records.
In California, for example, there is not true expungement. it is dismissed and it should show that under a finger print check as being dismissed. I can't tell you what happens in other states. I'm sure it depends. Sometimes when records are supposed to be deleted, there are errors, and it doesn't happen correctly. So, I think the best way to know is to do a self check and find out what is or isn't on your record.
