Approved I-140..What's next?

Wow! What a forum. Thanks a lot to the one who made this website very informative. I am new to this website and I hope someone could help me explain with regards to approve I-140.

My I-140 is already approved. Just want to ask you guys after this approval, when will the DS-230 forms will be given to me? Will there be a delay on the arrival of my DS-230 since retrogression is still ongoing?

We do not expect anything to be lifted in the next few months. The retrogression does not affect anyone until they have approval of the I-140 as that was never affected by any slowdown.

Even if things do get lifted, you have to factor in that there are only so many visas issued per year per the birth country, and the number allocated for the Philippines is just under 10,000 and that includes those from other professions that are still under the EB-3 category as well as as spouses and children, so you are looking at perhaps 2,000 or so for nurses all total per year. And there are many more that are waiting than that number. Those with completed files and have approval of their DS-230 will be at the head of the line.

Visas need to be completely current in all areas for them to send out the DS-230, or do anything further with any petition.

Would highly recommend getting two years of experience before coming to the US now.

I have just received an email from my immigration lawyer that my I140 has already been approved and checked also on USCIS website that an approval notice has been sent. My immigration lawyer has now asked me to pay for the legal fees to the amount of $2400 since I went thru direct hire so I need to shoulder the legal fees.

I've started to doubt if ever we will be able to reach America especially with the economic crisis they have also experiencing. My wife (also a nurse) and I still desire to work in America but unsure if it will only now a "DREAM". Is it still worth paying my legal fees? Am I right in saying that once your I140 will be approved you are now officially under retrogression?

Yes now our I140 has been approved you are affected by retrogression.

It is your decision on whether to continue with the application or not, if you are prepared to wait it out then go ahead and keep on with it. I too was going through direct hire and only had to pay my dh which we put half up front and obviously now we are not going we have lost that but the hospital was paying my fees

We was quoted something similar just for my husband. After I140 it is a case of waiting for PD to be processed and NVC will request biographic information on you and family members going with you

$2400 fee is for my whole family. It is a big amount and we're just fortunate that we still have full time jobs.

I've sat down and had a discussion with my wife and we decided that we'll pay for it and we'll just wait for our turn. My wife is also an NCLEX passer and would also love to work in America.

For the meantime we have already started applying in Vancouver, BC and hoping to hear from our prospective employers soon.

In that amount of $2400, will that cover all processing from start to end. I mean the lawyer's fee from the filling of your I-140 until your approval. How many person will that cover? And what state are you going to work?

That covers for my family of four (wife and 2 children). Hopefully going to the state of Texas.

My PD is March 31, 2008 processed at Texas Visa Center.

My lawyer charged me $1500. Half of it I paid when I submitted my documents. The other half will be paid when I have my visa. The fee is the whole process (from start to finish). Good luck to all of us who are waiting for our PDs to be current. Happy 2009! :)
