Any oregon RNs with 2 DUIs?

Hi everyone,

I got a DUI in 2011 and 2013, but wasn't convicted of my second one until the beginning of 2014 due to trying to get through school and the court pushing my court date further and further out. I have been sober for a year and a half (January 2013), I have applied to multiple positions and was offered a job through Avamere Rehab but when they did my background check the BCU denied my application and stated I was unable to work due to "posing a risk to others" my question is is this what will happen with long term care and rehab facilities or do all background checks go through them? I don't want to keep getting denied positions based on this and I am wondering if any other nurses know anything about Oregon rules from DHS AND THE BCU. Any input is needed. Thanks.

The board of nursing gave me my license. They know of everything. It's the company that does background checks through DHS that denied me.

That does not make sense. All background check info that I have ever seen has a disclaimer on it that they are only doing the check, they are not responsible for the decisions that come about after the results of that check. That's where I am confused because the board of nursing did not deny me....it's DHS.....is that the same? Would I need an attorney to fight DHS?

Depending on your state, the Board of Nursing may be run by the Department of Health Services.

OSBN is the OSBN, Washington is the DHS state... does this have anything to do with dual licensure?

Have you tried to contact DHS? Perhaps there are classes or programs. Idk, I'm a Oregon nurse and have worked with Oregon nurses who have had DUIs. There must be away. This is more of a legal issue though. We can't answer legal questions. Best of luck to you!

Yeah I have a few friends that have had no problems finding jobs with DUI's. I have sort of figured it out, if the employer uses DHS to conduct their background checks, then I will be denied employment, but if they go through another company I wont. It is only for employers that are getting more than 50% of their payments from medicaid and medicare. So I have to apply at private pay offices, dialysis centers, hospitals, etc., instead of nursing homes, in home care, and rehabilitation facilities.
