30 day notice???

Ok here is the story,,

I was hired as a NM of a nursing home and then in OCtober of 2005 I put in a letter to step down to charge nurse...WELL..they would not let me go to that position until they found someone to replace me SO i here it is April 2006 and I am still in the NM position. I have found another position and will be moving to it. BUT >>>>>it starts May 8th and I just gave my notice yesterday so I gave my present employer a 3 week and 1 day notice...they have three weeks until I leave and now they are telling me I need to give 4 weeks...I knew this before hand but my hands were tied and my current DON just now got back to the hospital regarding a reference so NOT MY FAULT>>>but i cannot give them 4 weeks only 3 weeks... is this wrong? now they are saying I am required to give 4 weeks? where does it say this? is this a law if you are in management? or is it courtesy? I feel that I have given them enough all ready and if i give them 4 weeks i will miss the May orientation at the hospital and will have to wait till June 12 which is too long...please let me know my rights....it does not say anything in the policy book about this...THanks

Usually, unless it is in writing, you go by the number of weeks of vacation that you have per year. Two weeks of vacation is two weeks notice, three weeks is three weeks notice. And that is just courtesy.

They have known that you were going to step down since you submitted it in wiritng 6 months ago, and did not let you do that then. They have had this much time to find a replacement for you, and have not. Why is it going to be different with the extra week? Sorry, but I do not buy their reasonong. You were better than most to just put up with it for so long. And because your facility was delayed, for what ever reason, in getting back to the hospital, it is not your fault. And do not let them try to make you think that it is.

A lot of places do expect a month's notice for management and "leadership" positions; however, as Suzanne noted, unless there is a written contract, serving a notice is strictly courtesy. They can't make you serve any notice at all.

It's your choice as to when you leave, but keep in mind that it will be your current employer's choice whether or not to consider you eligible for rehire and what kind of references to give in the future. That may matter to you, and it may not ... Sounds like this might be one of those, "the sooner (you get out of there), the better" situations. :)

The major dialysis company I worked for before traveling gives 5 WEEKS vacation the first year. When I left I gave 2 weeks notice to the day.

It also depends if the OP works in an "at will state".. That's where to find the answers.

As for the no re-hire again if the OP is in an "at will state" even if she gives "adequate" notice they could still list her as a No rehire.
