Hi everyone,

I wanted to know if anyone knew about how an arrest can affect getting your license? I was arrested for assault. The case was dismissed, and I was not convicted. For the board of nursing I saw that if you had a conviction you would be denied to get your license. How does dismissed assault charges work? Thanks any help works!

You should speak to your state BON. They are the final review for issuing you a license. You will have to submit your FBI background report when applying to take your boards, and the arrest will show.

I cannot speak for your nursing board or advise you legally, but in my state, you can attach a letter thoroughly explaining what happened to cause the arrest. You must be 100% honest and accurate about the arrest and circumstances surrounding it, and very detailed. If they see a discrepancy, they may not issue you a license. Something else they may consider is how long ago the arrest occurred. If it was recent, they may keep you in a pending status (because there may be a chance that charges could be brought forward).

You truly must call your BON and speak with them about it. There is no 'applies to all' answer to your question. Best of luck!

my state requires this be settled with the BON BEFORE you graduate so you will know if you are eligible to sit for NCLEX. The Board determine each case on it's own merit.

You can call the BON, no matter the status of your application. They can answer questions. They can explain policy. They can explain review procedures.

What they can't do is guarantee a student that when the school record and FBI report are submitted that they will approve everything and issue an authorization to test. They can't promise you anything until they see everything.
