I am a recovering addict. 3 years sober here. I have been recently accused if drug diverting. Agency nurse as well. My urine and blood were negative for any kind of opiates. I really need someone to talk to. The brand new DON at this facility has accused me. Because my situation has turned into a legal matter now. Anyone willing to listen?

I'm a bit sad I have a ton of views and no takers. Is there any other nurses who were accused of drug diverting and was actually innocent. I have worked hard for my 3 years of sobriety. This was insulting and hurtful. What was anyone's outcome. TIA

I'm listening. 3 years of sobriety is a great accomplishment. No one can take that away. Are you working a program? Do you have months of negative drug screens and positive case management reports? We need more info.

It sounds like to me that you need a lawyer to help you with this. What evidence do they have against you? Pyxis reports? Documentation errors? Co-worker complaints? They should have needed one or all of those things to even suspect you.

Were you terminated and was this sent to the BON? (I'm guessing so, but don't want to assume).

I'm sorry I don't have any answers, but I do suggest speaking to a lawyer. My experience was different than yours (guilty for diversion). I self-reported and have been in my state's monitoring program for 1.5 years. I'm very grateful for this as well, even though it can be daunting some days. However, I was avtively using and guilty.

If you are in fact innocent & sober (congrats!!!!!!) & facing this, gaining legal insight is going to be your best option.

I think you should run to the nearest testing facility and get a hair test. If you have to hire a lawyer, which I think you should, when it's all said and done, I would make that facility pay for your lawyer, court costs, drug testing, and lost wages.

Attorney, hair test. Very good advice. Definitely don't talk to anyone until you hire an attorney specialized in diversion.

Hello everyone again. First off thanks for the responses. So this happened 5 months ago. When I got accused they asked me to immediately come in for a urine and blood screen. Guess what yall? Both negative. I'm was an agency nurse BTW. The nurse accusing me is also the DON of the facility my former employer was sending me to. She was extremely shocked when my results came back negative. I thought well this will blow over and everyone will move on. I was wrong. After she received my results she called the police. And filed charges. A week later I had 3 cop cars outside my house issuing a warrant for my arrest. I spent 13 days in jail because the police of the state my charges were in never came and got me.

@willow14 I do have a lawyer the court appointed me. I was reported to the BON. I received a letter that I had been reported suspicious misuse of narcotics. Since then the BON didn't pursue the investigation. That's a big relief. But I'm still facing 3 felony charges. There is more to my story is anyone wants to hear

Run and get a comprehensive hair test for drugs, then call an attorney specializing in this type of case. If this does indeed confirm your statement that you did not use the drugs, then I would consider a lawsuit for wrongful dismissal, hostile work environment, damages, back wages, punitive damages and all expenses you've had to pay for.

Did all of these. Only thing I'm guilty of was not documenting the narcotics in a patients MAR. But only on the narcotic count sheet. Last time I checked you can't go to prison for lack of documentation on the pill
