Innocent but guilty due to not being in my nursing field....help!

Nurses Recovery

Published

Hello evwryone, I'm in serious trouble and have no idea what to do. I have never been in trouble before and do not have money for a defense lawyer. I was told that I would be revoked or I should surrender my license I don't understand either. I've been nursing 8 Years and had no issues however this is major. I don't know what to do. Also if I surrender in one state does that mean I have to surrender to all stayes?

Need more info. Take a breath.

Yes. What happened?

One thing at a time...it depends on what actions got you to this place. You're posting in the recovery section so I am going to assume you diverted medications from your workplace.

Does your state have an alternative to discipline?

Does your state go straight to the BON?

If you are a state without an alternative to discipline (like mine) I was also told to surrender or be revoked. I declined to surrender and went through the process of entering into a monitoring agreement.

Others here are familiar with alternative to discipline programs and can help you on that aspect.

First things first though, we need a *little* more information as to what brought you here. Keep it vague, no identifying details.

I have been a pp/nurse nurse for 10 years. I ended up accepting a job in med-surg it was a horrid travel assignment. They gave their new hires from other floors 3 pts and I would have 8-10. They were mainly dying cancer pts, very sick very heavily medicated. Now they say I diverted. I have done hair and ua tests all negative. I was told to surrender by the board.

Surrender, based on what evidence? All your tests were NEGATIVE.

I reported to floor manager and my recruiter I had no idea what I was doing with some of these pts...I hadn't had chest tubes....etc....they said it was complete and utter nursing negligence on my part because I said I didn't know how to care for them.

Sounds as if someone wants you to surrender your license based on what you said in a time of distress. Best to calm down and regroup.

Sounds like quite a sticky situation. Had you ever been oriented to that unit or type of work? And if not, I'm curious why you'd accept an assignment like that. Forgive me, I am not blaming you and I'm not sure how I'm coming across.

To prove negligence requires: Duty, Breach of Duty, Damages, and Causation.

Was harm a result? Ordinary Prudence as a trained nurse covers what you've been trained on, if I understand it appropriately. (I am not versed in these matters except in a very limited knowledge of it, having to look up things to at least get an understandable conversation going.)

Hire an attorney. There is something messed up about this.

They will revoke or remove them completely for negligence. I told the board the exact same thing so they used that against me.

I can not afford a good nursing attorney. Any nursing attorney for that matter. I found 2 and they pretty much laughed in my face because I'm not working and told me to seek public defender. I am being charged with nursing negligence for saying I didn't know what I was doing. But no harm come to any of my pts. And for diverting due to 4 vials of dilaudid not documented on, 12 not properly documented and time between taking the med from pyxix to waste was to long. So I have criminal court with public defenders as well. I understand that if I get a theft charge I will never get my license back. I did not divert this medication. My public defender doesn't even know anything about nursing. I worked so hard for them, 3 years is a long time to not be able to practice. If I surrender does that effect every state I'm licensed in? If they revoke ur license do u get them back?
